Richardson Facebook Case Adjourned

facebook-icon sheerThis morning [Jan 14], before Chief Magistrate Archie Warner, lawyer Charles Richardson’s “Facebook” defamation case was adjourned for mention on 31st March 2011 at 9:30am, to continue before Mr Warner.

The legal arguments ventured in the matters of Bemuda’s Constitution, the Constitutions of various other dependent and independent Caribbean countries and territories, the right and duties and powers of Maistrates Court versus those of the Supreme Court; and at one time even touching on cricket.

After hearing about 30 minutes of these lengthy legal arguments and rebuttals from Craig Attridge for Mr Richardson and Cindy Clarke for the DPP, Magistrate Warner offered to adjourn the case ‘sine die’. A ‘sine die’ adjournment would have meant the case would have been adjourned without an appointed date for resumption. In effect, the accepted and very well-known legal way of dropping a case without having to make a decision.

Ms Clarke objected and insisted on a fixed date for resumption. For Mr Richardson, Craig Attridge offered no strenuous objection. Mr Warner then agreed the 31st March date when the case comes back for mention.

    It’s pathetic that this even went to court. Should all 14 year olds trash talking each other on facebook take their cases to court too?

      If they were defamed – yes….

      The alleged comments if they are ruled to be defamatory will have a negative impact on a high ranking officer in the police service of a very small country. His reputation, whether it is decided that this is defamation or not has been tarnished. I know the individual concerned and can say that he is a dedicated and competent officer who has served his country well. Of course, most on this site dont want to consider that fact.

        But he’s white AND a police officer…So derogatory remarks are ok and actually encouraged in Bermuda towards such individuals.

        Shall we remind the audience of how it took the former BDA College lecturer almost 7 years to clear his name due to false accusations of racism and teh racist label attached to him which was utilized to manufacture his dismissal from the College? It seems that some don’t realize the damaging stigma that is accompanied by such false and inlfammatory accusations. If not here is the link below:

    But this is sad because this man is a lawyer. He should have known that his statement on facebook could have taken him to court. I’m sure he will no longer have any business

      Innocent until proven guilty.
      Come back in about 2 years when this case is finally settled, during which time Mr. Richardson will continue to strut around the place being the hero of the people and making a fortune from the gang issues in the country; he’s the go to guy.
      Such an intelligent, sharp lawyer though, not sure why he can’t just be the best he can be at that or whatever other positive things he has in his life. Can’t shift that chip on the shoulder no matter how many zeros are on the paycheques I guess.
      Sad.
