Court: Cannabis, Knife and Escaping Custody

April 6, 2011

Jahroy Simons, 25 and living in Southampton, pleaded guilty to and was convicted of two counts of possession of cannabis in Magistrates Court this morning [Apr.6]

The first charge arose out of a police stop-n-search operation on Queen Street in Hamilton on 3rd October 2010. In this incident he was found to have 0.8 grams of cannabis.

The second charge arose out of a police stop-n-search operation on Queen Street in Hamilton, thirteen days later, on 16th October 2010. In this incident he was found to have 1.7 grams of cannabis. Twice as much as before.

Because each offence took place in an increased penalty zone – within three hundred metres of Par-la-Ville park – Mr Simons, on each charge, was fined $1,000 for possession and $1,500 for being in an IPZ. Total fine was $5,000 and Magistrate Warner ruled that the fine must be paid immediately, that is before close of business today, or Mr Simons must serve 90 days on each charge, with time to run consecutively.

Mr Simons also faced two other charges. One of escaping lawful custody on 5th April 2011. He pleaded guilty to this charge and the Prosecutor gave evidence that Mr Simons had been stopped and searched in Victoria Park, and had been placed under arrest for having a ‘pointed article’ with a 3.5 inch blade in his possession. He had then run away only to be recaptured about 100 metres away at the North end of Washington Street.

The second charge stemming from this incident was that of possessing a “pointed article”. Mr Simons pleaded guilty to the escape charge but not guilty to the possession charge. Magistrate Warner ruled that the two charges would be dealt with together and that Mr Simons would be bailed for $5,000 with one surety to appear for trial on 20 July 2011.

dumb ditty dumb dumb….caught in the same spot two weeks apart…cheeze bye
    things that make you hmmmmmmmm

  2. Ouch says:

Up to 6 months for 2.5grams of Marijuana. Shocking. This crazyness has got to stop. If he had a couple oz in bags for sale, fine lock him up. But, 6 months for minor possession for personal use is cruel and unusual.

    • Truth says:

No, it’s not cruel and unusual. IT’S THE LAW.

      • Ya'll are just not smart enough says:

If its the law, then what do yo uhave to say about this: http://bernews.com/2011/03/accounting-intern-has-weed-charge-dropped/

Where is the consistency in sentences?? If weed is illegal, then no matter what your previous record is yo ushould be getting hefty fine or a hefty sentence! Think about it, we are saying that if you have no previous offences then yo ucan go free. But let there be murder or something major we want to through the book at em! All I am saying is that there is no consistency with our current system. And to let ya’ll know, the youths of today know and see the flaws and it is a major factor with why they have no respect for it! In thier eyes we that support this broken system are complete idiots because just like the system wee contradict ourselves.

Also, contrary to a comment made by someone below that no weed = no murders, that is just a far fetched rediculous comment because there would be still cocaine, heroine, LSD, PCP, and the list goes on! Get educated mate.

        • LOL (original) says:

So do you not free that factors can play on people judgments? Again this guy and the intern are 2 different people. One can show that he is working to be a positive contributor to himself, his family (future?) and also country and the other guy is a repeat offender who to my knowledge has not presented any argument for him self to show he is serious about staying to the straight and narrow WTF he not only did he have weed on him twice he had a knife and tried to escape custody again justify you opinion all you want the facts just don’t support your argument. Guess your name says it all you know everything ……………….

          LOL

  3. Unbelievable says:

His reoccurance in such a short span of time shows he don’t care that he broke the law hence the strong arm of the law came down on him. It seems that simple to me.

  4. mixitup says:

    Einstein!

  5. wow says:

The whole island is virtually an increased penalty zone being so small with so many churches, schools etc

  6. Terry says:

CKE…..Pretty close to KFC, just a letter away………………..As for the “second charge of pointed article”……plead nut gillty…….detz right….”I was having a Viagra moment your worship. Is that a crime? Tell me…is that a crime”?…..

  7. mixedup says:

meanwhile, his little 2.5 grams which probably cost him around $100, could cost us approximately $45,000. doesn’t make sense to me. There has to be another way of dealing with these situations.

    • enough says:

There is…don’t buy it or at least don’t get caught with it.
      STFU when you do.
      Choices.

WHATTTTTTT? .8 GRAMS. DOES ANYONE KNOW HOW LITTLE THAT IS??????????? IM A BERMUDIAN THAT LIVES IN CANADA. DO YOU KNOW THAT YOU CAN HAVE UP TO ABOUT 7 GRAMS IN YOUR POSSESSION. THE POLICE CAN SEARCH YOU AND ITS NOT A PROBLEM AT ALL. OF COURSE ITS DECRIMINALIZED THOUGH. HE GOT 6 MONTHS FOR SOMETHING THATS NOT EVEN A WHOLE GRAM???????????? THIS IS CRAZY. SOOOO LET ME GET THIS STRAIGHT. YOU CAN GET DRUNK, RIGHT OFF A CAR, FIGHT IN CLUBS FOR STUPID REASONS, MAKE THE WORST MISTAKES IN YOUR LIFE. BUT 0.8 GRAMS OF PEACE PLANT AND ITS OFF TO JAIL. BERMUDA IS STILL STUCK IN THAT RICHARD NICKSON MINDSET. OUTLAW AND CRIMINALIZE THINGS THAT MELLOW YOU OUT BUT PROMOTE AND GIVE A SLAP ON THE WRIST FOR LIFE ALTERING DRUGS LIKE ALCOHOL. FOR ALL THOSE THAT DONT UNDERSTAND WHAT I MEAN BY RICHARD NICKSON THIS IS WHAT I MEAN. RICHARD NICKSON WANTED TO GO TO WAR IN THE 70′S THE US PUBLIC ALL ABOUT THIER FREEDOM RIGHTS MOVEMENT AND HIPPIENESS WAS AGAINST THIS IDEA OF GOING TO WAR. SO NICKSON SAID “HMMMM HOW CAN I COMBAT PEACEFULNESS. OH I GOT IT, LETS MAKE WHATEVER THEY SMOKE A CRIME SO THAT THEY CANT ALL COME TOGETHER IN PEACEFUL ENVIRONMENTS AND CONGREGATE TOGETHER. THIS PLANT IS CAUSING PEOPLE TO STOP AND THINK ABOUT OUR ACTIONS INSTEAD OF JUST JUMPING INTO WAR. SO LETS MAKE THIS A PLANT OF EVIL BECAUSE IT DOESNT MAKE PEOPLE DO WHAT WE WANT THEM TO DO”. SO THATS WHY MARIJUANA A PEACE PLANT IS OUTLAWED AND A DESTRUCTIVE EVIL LIQUID IS. BECAUSE THEY WANT YOU TO BE DESTRUCTIVE. THE MAJOR FACT BEFORE I END IS THIS ALCOHOL KILLS AN AVERAGE OF 250,000 PEOPLE A YEAR. MARIJUANA HASNT CLAIMED A LIFE TO DATE YET. THERES NO DOCUMENTED DEATH CAUSED BY MARIJUANA. PEOPLE DONT LET THE GOVERNMENT THINK FOR YOU. DECIDE FOR YOURSELF WHATS RIGHT. DO THE RESEARCH. WE NEED A REVOLUTION!!!!

You need to find the capslock button and if you cant look above the shift button.

  9. One Love says:

Confirmed, we really are not much better than a small southern town in the US. $5,000 for 1,7 grams of erb, wow. Let’s attempt to pay down our debt by fining citizens for everything.

  10. Can you handle this says:

“Accounting Intern Has Weed Charge Dropped” was the title of an article last week and yes I am going to go there..please explain to me how the hell one person can get off and others charged….it really makes one believe that it is who you know and it is definetely something that makes you go hmmmmmmmm…….that’s why this island is so “f&*^ed-up” there doesn’t seem to be any consistency in sentencing…I swear they must spin the wheel and wherever the pointer stops is what you get!……

    • Reality says:

Did it every occur to you that Simons has a bad record of offenses? This island isn’t effed up, Simons simply didn’t learn his lesson. I’m sure if the inter got caught twice within 2 weeks and then had other charges brought up against him then the judge will throw the book at him. This is a clear case of some people learning from their mistakes and some who do not.

      • Can you handle this says:

@ Reality….Whatever the fact that his (interns) charges were dismissed altogether is my point. You know for a fact that there is no consistency when it comes to sentencing period..you read cases everyday in the paper..did that occur to you??? I’m glad you feel that you know what the Judge would have gave him (intern) if he had committed another crime..sounds like you have a crystal ball..I along with many in the community can concur that sentences metted out are sometimes not adequate for the crime committed……..

        • LOL (original) says:

@Can you handle this you must be stupid can’t you read! This guy (artical above) had two offences in a short time showing he does not care about the law. This is not a one off case. This guy vs the intern atleast the intern is doing something with his life and is persuing the road that could lead to him being a positive contributer to our contry but I guess you would rather him to have the record so we can add another of Bermudas youth to the criminal/gang list you must be one of those that want to lock up all the black youths or something. What is this other guys story is he doing anything? Also he seems to be a repeat offender this is part of the desion the intern had a clean record in the laws eyes as he had never been charged before. The last artical you and others were upset about was an importation charge again not the same thing as possesion.

          LOL

          • Ya'll are just not smart enough says:

I have no record either. Are you saying that if I commit murder the judge should consider the act that I have no previous record and sshould be let off with a warning? Becasue thats what you are saying in your comment! Those that have no previous record should be let off on the grounds that it can tarnish his record. And I quote you “the intern is doing something with his life and is persuing the road that could lead to him being a positive contributer to our contry but I guess you would rather him to have the record so we can add another of Bermudas youth to the criminal/gang list you must be one of those that want to lock up all the black youths or something” unquote. I’m doing something positive with my life, but I could possibly murder someoen on the grounds that they constantly torment me or whatever. ‘Can You Handle This’ is simply saying that there is no consistency with our system; and to add to that, the youths of today can see those flaws.

            • LOL (original) says:

No sorry murder is a capital offense possession is not period. These crimes are not in the same category please keep your arguments in perspective of the severity of the crime. Again I repeat MURRDER is a CAPITAL OFFENSE in this case it does not matter if the person committing this crime has a prior its murder. In the case above (this article) again I repeat this guy is a repeat offender and has not presented any evidence that he is trying to straighten his ways. Infact look at the title of the article “Court: Cannabis, KNIFE and ESCAPING CUSTODY” Your response holds not weight in this discussion held up to scrutiny. So I guess your not as smart as you think.

              LOL

              • Ya'll are just not smart enough says:

Blah blah blah. My point was and has always been ‘No consistency in the handing out of sentences.’

                • LOL (original) says:

Consistency can only be weighed with like crimes, which is not the case here. If you used like crimes in your argument I would not have commented in the first place. Instead you are just hating on a Bermudian who is trying to accomplish something and comparing him to a person who is hindering himself not once but twice caught with a pointed article and escaping custody. Guess facts aren’t important to you. Crabs in a barrel I’m sure you’ve hear that saying before.
                  LOL

                • LOL (original) says:

According to your logic we should be locking up speeders to after all thats breaking the law too.

                  LOL

    Running Man…grab grass n haul a$$

  12. wondering says:

this island is finished with ultra liberals trying to ruin a community…the facts about weed are often skewed and you have to include the facts about the socio-economic problems the majority of Bermuda and with weed which is still illegal….yes ILLEGAL……and is associated with nefarious activity.let’s face it. if there were no weed there would be other problems but it wouldn’t be illegal rum sales or senseless killing!

too often we dumb ourselves down in order to feel superior……don’t know why but if you are working 100% of the time to achieve 50% as the top mark then you desrve the full extent of the law!

    • Crucial says:

Did you just say if there was no weed there would be no senseless killing?!!!
And ALL things illegal are associated with nefarious activity. That is like saying that all fish are associated with things that are wet! Are you serious?!

    • Ya'll are just not smart enough says:

Genious, pure genious response there mate. You obiviously have no idea what you are talking about. No weed = no killings???? Give that man a degree in ‘I have no idea what I am talking about’!

    • Just wondering says:

Have you ever noticed that when the Police do massive drug busts and the weed supply is very low, fights and violence seem to increase?

      • Ya'll are just not smart enough says:

Ok, where exactly do you stay?? Cause here in town, that does not apply! When Money is low as a result of police busts then you have low weed and white lady, then there are fights and violence on the rise. Not just weed! Get ya facts right. And shall I say it again, no weed = no killings???? Since I can’t get high, I wanna go out and murder someone. Does that sound right to you at all??? So far-fethched that it gives me a headache thinking about how you guys come up with these lame brain opinions.

We need to remember that the real point behind all these posts, illegal is illegal and there is no consistency in our justice system.

  13. boston baked bean says:

Hopefully “Dee” is not in Canada in college. Functionally illiterate. It’s RICHARD NIXON. Bermudian in Canada talking U.S. politics. Give me a break.
