Sex Offender Jailed For 18 Months

Pleading guilty to two counts of sexual assault on his 14-year-old cousin a 19- year-old – who cannot be named for legal reasons – was jailed for eighteen months yesterday [May 26].

Magistrate Archie Warner was told that the two offences took place between 1st September and 30th November 2010 and were separated by about ten days.

The Prosecutor told the Magistrate that two families lived in the same house with one family living upstairs and the other downstairs. The first offence involved the victim being pushed against a wall and sexually assaulted, and was interrupted as the defendant heard someone approach.

The second offence, about seven to ten days later, took place after the 14-year-old victim had stayed home from school and was in bed with the flu. The Court was told that the defendant was well aware of the age of the victim.

Seeking mitigation, the defendant’s lawyer, Mr Llewellyn Peniston, told the Magistrate that neither the victim nor the victim’s family had wanted the matter to go to Court.  However Magistrate Warner pointed out that even if parents were unwilling to protect their own children, it was still the duty of the Court to do so.

Mr Peniston submitted that the defendant should receive a sentence of community service as he was currently employed, seemed to have a good future with his current employer who was considering sending him overseas for further training, and was in the Bermuda Regiment where he was subject to rigourous discipline.

The Magistrate cited the Social Inquiry Report which indicated that it could not assess the risk of the defendant’s re-offending by committing similar acts.

Having heard the DPP’s request for a prison sentence of two to three years, Magistrate Warner sentenced the defendant to eighteen months imprisonment on each count with sentences to run concurrently.

He also ordered that after release, the defendant should serve two years probation and that during his incarceration, he should be given all the necessary sexual offender rehabilitation counselling and training that is available.

    A person commits a sexual offense and receives 18 months while a person with weed for medical reasons gets 30 days and $2000 fine.

    It makes me go mmmmmm.

      She was a frequent traveler to Bermuda and bought over an oz of weed..That is worth easily $2500. If she had 3 grams like the women who was charged $2000 she wouldnt have went jail..But she went up for intent to supply most likely which is a worst crime to commit.

    Am I hearing this right, the family was trying to keep this abuse under wraps and get this man community service!!!???? If he could do something like this at 19 then imagine what will happen down the road if he doesn’t get help for his perversions. My heart goes out to the victim and I just hope her parents get her counseling instead of acting like it never happened!

      I don’t think the family requested community service, that was his lawyer’s idea. Families and victims often try to avoid the courts because of the stress, the embarassment and the humiliation to which the victim is often subjected. Lawyers for the defendent think nothing of accusing the victim of “wanting it” and dragging her character through the mud. Also families often still think if you don’t talk about it, it will go away; that the victim needs to “get on with her life” not recognizing that justice helps the healing process. Even if the perpetrator is not convicted, going to court is a way of taking back the control over one’s life that the perp took away, turning one into a survivor and no longer a victim.

      um I don’t think that is correct since the Americans are all about ‘innocent until proven guilty’ and it would interfere with their ‘right to a fair’ trial.

        You’re both correct actually. Once a person is convicted then they post their name and picture. some of their court cases are publicized depending on how major it is but you won’t generally know until after the fact.

          yes this man has been proven guilty and we need to follow suit and let people know especially if he turns out to be a repeat offender. counseling doesn’t work for everyone.

    He deserved the 18months or so….This could have led to rape or somthing along those lines, and he crossed the line more than once. The young lady in this case, im glad she stood up to him and decided or with the help of her parents decided to go to court. IM sure he was warned the first time. No matter what the outcome is…no man has the right to assault a young woman when she is defenseless, and isn’t seeking your attention. Keep your head up and dong the right thing even if jail time is served is the best thing, lets hope he learn’t his lesson, and he keeps his hands and actions to himself next time. No one likes a “womanizer”

      Unlikely to happen. Bermuda is the only place I know of where child molesters don’t have to be isolated from the rest of the prison population. I am guessing that’s because they are seen as kindred spirits

    I hope this little girl gets professional assistance to deal with the horror she was put through. All parents should educate themselves and teach their children about predators. A book I highly recommend is: Protecting the Gift by Gavin de Becker. which addresses this subject.
