$1,000 Fine For Heroin Possession

In Magistrates Court this morning [Nov.29], before Senior Magistrate Archie Warner, 60-year-old Wendell Santucci pleaded guilty to possessing 0.05 grams of the controlled drug diamorphine [heroin] in the playground parking lot on Parson’s Road in Pembroke at 10:00am on 19th August 2011.

The DPP Prosecutor told the Magistrate that Mr Santucci was seen in a car with another person. The Police had cause to search the car and its occupants. However, on this initial search, nothing was found. But Mr Santucci was then taken to Hamilton Police Station on a warrant on another matter.

On being searched again at the Police Station, a plastic bag containing what later turned out to be diamorphine was found tucked away in the hatband of Mr Santucci’s hat.

Lawyer Peter Farge, counsel for Mr Santucci, told the Magistrate that his client was seeking help for his drug use problem through Turning Point.

The Magistrate fined him $1,000, and sfter being asked for time to pay, Mr Santucci was given until 29th December to pay his $1,000 or face 30 days in prison in default.
