Family On Weapon, Drugs Charges

A father, his two sons, and the son’s girlfriend appeared in Magistrates Court this morning [Dec.23] facing a variety of charges including possessing a prohibited weapon, illegal drugs, and obstructing police.

All the alleged offences stemmed from a Police search of their residence at Ord Valley Lane, Warwick at 5.40am this past Wednesday [Dec.21].

47-year-old father Lindley Scott and his 22- year old son Lekan Scott were jointly charged with obstructing Police and using threatening behavior towards Police. Each man pleaded not guilty.

Lekan Scott and Danielle Eatherley, who Lekan Scott described as his girlfriend, faced two charges: possessing a prohibited weapon identified as a Marksman Air pistol, and  possession of a [unspecified] quantity of heroin. Mr Scott pleaded guilty to both charges, while Ms Eatherley pleaded not guilty.

17- year-old Luri Scott was charged with the possession of an illegal drug – cannabis. He pleaded guilty to this charge.

In stating the facts that related to the guilty pleas that had been entered, Senior Magistrate Archie Warner was told that Police, responding to information about a firearm, had raided and searched the Scott residence in Warwick.

Their search turned up marijuana in the room occupied by Luri Scott. The firearm and heroin were found in the bedroom occupied by Lindley Scott and his wife. Danielle Eartherly had told Police that the drugs found in Lindley Scott’s bedroom was ‘dope’ [heroin] and that the gun was hers.

However, Lekan Scott also claimed ownership of the gun saying that he had found it on the Railway Trail and decided to keep it to protect himself from gang members; and he told the Police that the drugs were his

The Senior Magistrate ordered a Social Inquiry Report [SIR] and BARC report on Luri Scott, granted him bail of $2,000 with one surety, and ordered him to return for sentencing on 15th February 2012.

Lindley Scott, the father, was also released on $2,000 bail with one surety and ordered to return for trial on 1st February 2012.

Lekan Scott must have a SIR and must return on 1st February 2012 for sentencing. He was remanded into custody.

Danielle Eatherley was also remanded into custody until her trial date of 1st February 2012.

On hearing that she was to go into custody Ms Eatherley asked the Senior Magistrate if he could grant her bail as she did not want to miss her children’s Christmas. But Magistrate Warner said that she was facing a firearms charge and that bail would not be granted.

After the door in the prisoner enclosure had closed behind her, for several minutes, Ms Eatherley could still be heard wailing and screaming that she was missing her people and that she loved her mother. From the public Court gallery, a female voice shouted back: “We love you Danielle.”

      Still a weapon, still prohibited in Bermuda, still capable of inflicting GBH and even death if used against another human being.       Sure its still a weapon, and sure its prohibited, and sure they should still get the same or some stiff penalty if they allegedly had it, but at the same time bb guns dont kill people.

      Its kinda like catching someone with a box cutter and then reporting on how they had a butterfly knife..

      its more an argument of semantics for the article then law/pentaly difference in my opinion.

    $2,000 dollar bail judge?!!!! What do we pay you for, sympathy, mercy? You are a JOKE! charging a tourist $2500 for simple possession and ruining there trip, to people that have guns and drugs and have clearly been doing this for some time just being let go?!

      I agree with you and am very disappointed at Mr. Perinchiefs race card comments. The race card has been used sooooo much over the last 13 years that nobody reacts to it anymore. Just wondering how many race cards left in the deck. You see we have become wise to those that try and shift focus and blame by using the race card. It does not work anymore!

      Why does he even want to rely on help from England and criticize them when they dont come rushing in with help? Isnt this the same government that a few years ago was pushing the independence issue! Pushing the “we can do it on our own, without them” message and trying to seperate from England and move towards Caricom?. As a former Police Commissioner (I believe but forgive me if Im wrong) and member of this government does he not accept some responsibility? Isn’t another fellow PLP MP (Mr. Smith)the immediate past Police Commissioner. Maybe he can point the finger at them. Is this current government not going to accept any blame for the way things are. These kids went to school on the PLP watch…lived under the PLP system of goverment. Cant blame whitey….the UBP or anyone else.,,but your fellow MP’s.     The ammount of money you make from drugs is no where near the ammount of money my freedom is worth.

    Locking somebody up for posession of a BB gun is a bit much. I mean really, the thing is not lethal. It shoots pellets. You just might be able to kill a rat, 4 legged variety, with it but it would take a very well placed shot. You can pick these guns up off the shelf at Walmart. No license, no background checks required.

    Don’t get me wrong. I have no sympathy for this drug family. Behind bars is the place for them to be. It is just that a BB gun is certainly no firearm capable of killing anyone.

        Who cares if it was only a BB gun? If someone broke into my house with one of those I would not know the difference and would be terrified along with my kids just as if it were real. Maybe it would not cause any “real” lethal damage, but the psychological damage alone would haunt me for life, not to mention whatever this person was able to do to me or my kids as a result of having this weapon.

        Just because you can buy it on Amazon or Walmart doesn’t mean it is ok.

      the legal system must know the difference between a firearm and an airgun? how can you charge someone for having a firearm when it clearly is not a firearm? I’m not a lawyer but even I could argue against that charge. The best you could do with that little BB gun is piss someone off with it or maybe take out an eye with an expert level shot..any BB gun experts in this family? to funny, book them on the drugs and stop embarashing yourself with charges on BB guns…

        the lawyer may be able to argue it, but as far as i know, all projectile weapons are classified the same way (no clue how we get bow n arrows here tho)

        i think it is technically a gun, it just uses something other than gunpowder to shoot the projectile. Dunno how bermuda law writes it up, but im assuming thats what links the two.

        They didn’t get charged for having a ‘firearm’. They were charged with possession of a prohibited weapon. A BB gun is a prohibited weapon. In this age of thugs and wannabe thugs running around with firearms (real and fake) robbing and shooting how can you try and make excuses for anybody found in possession of one?

        I don’t know about you but I value my vision so if the gun is capable of causing any degree of injury then any person who may be in possession of it needs to be dealt with seriously. Guns are illegal in Bermuda- they should not have had it. End of story.

      Depends on the air gun, not all of them shoot little round BB pellets!!! Some shoot more harmful varieties of projectile, to minimize this sort of thing is kind of dumb. You can pick up .22 rifles from Walmart, no license, no background checks in some states, so…does that make it any more okay to bring weapons like those in? Nope. Simply unnecessary, still illegal no matter how you wish to dilute it. Get one of those BBs in your face and see if it’s no big deal. Honestly, it’s that sort of mentality that’s made Bermuda the gangsta’s paradise.

      Sure did. Did you really read or did you skim over some of the key words real quick & only once?

      In the real world, the one Bermuda is not a part of, a BB gun is not a weapon, not by any stretch of the imagination. It is not a lethal weapon. I would not be surprised if they can be bought in Toys R Us, though I have never looked there. They are considered as toys for older kids elsewhere.

      Go after the thugs with the real guns. BPS time much better used.

        Actually they are not sold at Toys R Us. But, you can buy them at Walmart…but ten again you can buy guns, slingshots, and ammo there as well. These are sold in the sports section…NOT the the TOY section. They are not safe and can bling someone, injure someone and YES even kill someone.

      I agree. Ask anyone that has even been threatened and robbed at gun point and weeks later found that the robber used a BB gun if they felt any less terrified or if the nightmares stopped. The answer is NO….how do I know. ….because I was that person, robbed at gunpoint with two guns to my head by the punks that robbed me in Detroit. They punks were caught and months later in court I learned that they used BB guns. The damage was done! I didn’t feel any better, nor did I sleep better. It took months of therapy and medication that I had to pay for.

      Real gun, BB gun or Fake gun…make no difference. The result and effect on the VICTIM is the same. Lock them up for LIFE!

Bladed weapons are also illegal but u can still buy a knife for about 5 bucks and carry it around with u and use it to kill someone so dont use cost and easy access as an excuse!       Was this young lady thinking of her babies when she was admitting to the heroin possession? Was she thinking of her babies choosing to be the girlfriend of a man who either sells or uses heroin? It is time that people accept that your actions have consequences…breaking the law is just that. Arguing over what type of prohibited weapon was in the possession is a waste of time….having one is still illegal and I am sure they didn’t have it to shoot some tin cans in the back yard. So to all those defending this young couple know that if you do wrong one day it catches up to you the choice is yours.

    The sad thing is this 22 year old has a daughter not even 1 year old yet and will miss out on her life. As for the girlfriend her kids didn’t matter all this time and he wasn’t paying attention either. Let them do some serious jail time to really think about their actions and the lives the have affected

    They ALL need to do serious jail time if all are found guilty. It’s too much of these people; black and white, thinking they can totally disregard the law and do what they feel. The police did a fantastic job and I hope ALL 4 of them are punished to the full extent of the law if found guilty.

    We are dealing with too many issues on the island, and it’s time the criminals sit up and pay attention.

    Nothing came from this situation. The courts decided not to pursue the matter with Eatherley, despite the fact that this young woman had a prior conviction in 2011. And she has twins?!
