18 Month Sentence For Break-In

48-year-old Ricardo Tucker, said to be of no fixed abode, was this morning [Jan.6] sentenced to 18 months in prison to be followed by two years on probation.

Before sentencing him, Senior Magistrate Archie Warner told Mr Tucker that his record showed that he had a long history of trespassing and breaking into other people’s houses.

The facts of this offence were that around 8:00pm on the night of 3rd January 2012, Mr Tucker had broken into a rooming house in Joell’s Alley in Hamilton and had knocked on the door of one of a resident, demanding entrance to her room. Being denied entrance, Mr Tucker had then left the building.

However, about five hours later, Mr Tucker returned around 1:12am and again re-entered the building. He ended up barricading himself into a room which required attending police to break into the room in order to extract him.

Mr Tucker had claimed that he had been allowed entry by the Caretaker. However, in evidence, the Caretaker denied this. In mitigation, Duty Counsel Leopold Mills said that Mr Tucker had a serious problem with alcohol and that this should be taken into consideration.

After release, and whilst on probation, Mr Tucker will be required to attend all rehabilitative courses that are asset or recommended by the Department of Court Services.

    Good, so glad he is locked up. My daughter just had her house broken into this week, and the cuplrit left with her handbag. He came in via the bathroom window at night while she was sleeping, with her new born baby beside her in his crib. What terror he has left my daughter in. Break into her mother’s house and see what will be waiting for you.!!!!! Lock them all up.

      Wow ..I feel your pain I have experinced the same sort of situation…you never get over it, and these disgusting human beings are seving time at west gate…they all have the best health care that is provided for them at no cost !!!!!!!!!they have dental care and what ever else medical care they need !!!!!!!SOMETHING IS WRONG here !!!!!!!!!!!I am so fed up with the premier….

    …so even with a long history or breaking and entering offences the best the courts can do is 18 months? Given how things go at West gate he’ll be out in 4 months.

    Way to teach him a lesson. Either the laws regarding this is outdated or our Judges are out of touch with reality ..or both.
