Repeat Offender Jailed: Stealing Liquor

64-year-old habitual offender Sinclair Lewis Fox was this morning [Feb.27] sent to prison for three months after pleading guilty to two counts of trespassing and stealing liquor and wine to a total value of $250. Mr Fox was said to be unemployed and of no fixed abode, and also to have burgled his own lawyer’s office previously.

The Prosecutor told Senior Magistrate Archie Warner that on 5th and 15th February 2012, Mr Fox had been captured and recorded on CCTV as he took wine and liquor off shelves that were in Café 4 on Queen Street in Hamilton after the shop had closed for the night. Mr Fox was seen entering and leaving from the Queen Street side.

Referring to Mr Fox’s priors, the Prosecutor told the Senior Magistrate that Mr Fox’s offending had begun in 1969. Duty Counsel Mr Leopold Mills asked that Mr Fox could be referred to helping agencies who might be able to help him reform. But the Senior Magistrate denied this saying Mr Fox’s record was long and showed that he would only reform when he had decided to do so.

Prompted by the Magistrate who had just reviewed Mr Fox’s record, Mr Mills admitted an acquaintance with Mr Fox, both from this morning’s legal and professional encounter, and from a previous acquaintance when Mr Fox had burgled an office that was, at the time, occupied by Mr Mill’s law office.

Later recounting the incident, Mr Mills said that some years ago, Mr Mills had been called to his law office premises after the burglar alarm system had activated and, on arrival, found Mr Fox inside the building. Mr Fox requested that Mr Mills should help him to leave the location, but Mr Mills said that he demurred and instead suggested that they wait for Police to arrive. Police arrived and arrested Mr Fox.

The three month sentence was for each count and the sentences were to run concurrently

    This guy has been offending for over 40 years and clearly his jail time isn’t teaching him a lesson!
    3 months isn’t going to teach him anything, he’s used to it by now… for him it’s probably just going to become a roof and food that he can count on!
