Conditional Discharge For Illegal Dog Breeding

March 15, 2013

Sandys parish resident Mr Vernon Charles, 45, was given a conditional discharge in Magistrates Court after he pleaded guilty to a charge of breeding a dog without a breeder’s license.

Crown Prosecutor Garrett Byrne told Senior Magistrate Archie Warner that in August 2012, Mr Charles had been reported as someone who was breeding a Doberman Pinscher. The Dog Warden had intervened and, under the Dog’s Act, had taken legal action against Mr Charles.

Mr Charles admitted that the dog, said to be worth $4,000, belonged to him and that he had been showing the dog at dog shows. He said that with his knowledge, the dog had gotten pregnant but had later developed complications while giving birth to her puppies.

He said that he had taken the dog to the vet who had delivered six live pups. Mr Charles said within two days, all six pups had died; and he had a $2,000 vet’s bill.

The Dog Warden said that Mr Charles had applied for a license to breed the dog, but that he did not actually have a breeders’s license.

The Senior Magistrate said that given that all the puppies were dead, the charge of illegally breeding was of doubtful validity and that the matter could, in his view, be dealt with by way of a Conditional Discharge. The Crown Prosecutor agreed and the Magistrate handed down an order of a Conditional Discharge.

Good. Now NEVER allow him to get another dog or breeder’s license again. Idiot.

    • dun says:

what? why not? what did he do wrong?

god, some of us bermudians are damn right dumb.

      • Concerned says:

Yes, “dun” very dumb, like you! What did he do wrong? He bred his dog without a license, moron. Had the puppies not sadly died, what then? This is a pathetic ruling. He broke the law, he needs to be accountable.

This is like me going out and driving drunk, getting pulled over and given a ticket but when I go to court I say “hey judge, yes, I was wasted and driving but I didn’t get into an accident and die or kill anyone so I’d like a conditional discharge please. Oh, and by the way, getting home cost me $2000 in gas so again, conditional discharge please.”

Yes, “some of us Bermudians are damn right dumb.”

I think the ruling is just fine if you ask me. Don’t act like you have not broken a law or two in your life, it is just that most times we get away with it (speeding for example). But if we get caught we hope for a second chance. It is clear that the man has a passion for dogs considering he use to enter his into dog shows. He just made a bad choice, everyone makes them a few times in life! Including you. No one is perfect.

And it is not like he asked for conditional discharge, that is what the judge gave him. And I am sure he was not using the $2,000 as an excuse to get out of a fine either. I am pretty sure he was just telling his story, which is what is suppose to happen in the court room. So why are you exaggerating the story?

It is amazing though how so many pit bull litters are born but the warden can’t find them to prosecute them. One only needs to look around the island to see all the illegal pit bull puppies being walked on the streets.

@ Deliverance & Concerned: You people make me laugh…. The both of you should get in a dingy together with a full tank of fuel and head straight out to sea, never to return.

Those of you who think you know everything are a F#@kin nuisance to Us that do!!! it’s like the Old Time Mafia, forcing people to pay for their God given right to live in peace…It’s OK to Breed if you PAY me… but if you don’t PAY me…you become food for the fishes… i’m starting to believe that these Gangstaz are targeting the wrong people…or maybe they are on the payroll…what do you think..?

  5. The Bermuda Kennel Club is a great World respected organization. Similar to the CKC, AKC, and UKC too..eh..

The Bermuda Islands, are to me, the nicest island chain in the world. In Bermuda they do enforce the rules of Law.. Ya think other countries will now someday too.. is that what laws are meant to be ..? If when enforced others do not so quickly try to break them..

GOD Bless Bermuda and may GOD Bless you!

  6. Malachi says:

What we need is a law banning illegal child breeding.

We need a license to open a business; a lincense to drive a car; a license to own a dog.

But anybody can have a baby!

    Go figure!

Wow, I agree 100%. Was waiting for someone to say it.

  7. BermudaGirl says:

This involved the lives of puppies, and quite possibly endangered the mom’s life. How does the dog get pregnant, and he was unaware? PLEEZ! The dog should have been spayed if he is so careless.

  8. hello! says:

you can clearly see just like our four legged friends how badly we as humans have bin domesticated. its so sad the way you think a human should be charged and prosecuted for two dog’s shagging in the bush. i just thinks it’s a crying shame the way you people think sometimes. who the hell wants a licence to have a child your parents should have needed a licence to have you and got denied!!!!
