‘Roof Painter’ Sentenced Retroactively For Fraud

A 47 year old man was today [Nov 19] given a six month prison sentence for defrauding a householder of $1,069 by taking a deposit and promising to paint her roof, but never returning to do the work.

Anthony Dyer’s sentence was retroactive, dated back to June 2012 when he was last jailed for a similar offence.

Prosecutor Cindy Clarke told the Senior Magistrate that on 7th June 2012, Dyer had approached a Pembroke householder and offered to repair and repaint her roof. He quoted $3,000 for the job and offered two references.

The householder called the references, and after getting a good reference she decided to hire Dyer. She agreed to pay some of the cost upfront so Dyer could purchase materials and bring them to the site.

The householder gave Dyer a personal cheque for $1,069, and then arranged for a ladder so that Dyer could have access to the roof. However, he never showed up again and the householder contacted police and Dyer was later arrested.

The defendant had been convicted of a similar offence in June 2012, and was jailed for six months and released in October 2012.

Senior Magistrate Archie Warner said that this 7th June 2012 offence should have been dealt with at the last trial in 2012. He said that he would treat this new charge as being part of that series of offences and would sentence accordingly.

The Senior Magistrate ordered that today’s six month jail sentence was to take effect from 25th June 2012, which was the start date of Dyer’s last jail sentence. That means Dyer has already served the time.

Dyer then faced the Court over outstanding fines totaling nearly $2,000. He said that he was awaiting payment for a roof that he had actually painted, telling the Magistrate that the “lady was treating him unfairly” by not paying him when she promised to do so.

The Senior Magistrate then told Dyer that he was now “getting a taste of his own medicine,” and gave Dyer until 19th December to settle the unpaid fines or face jail time in default.

    Convicted of a second fraud and the Magistrate say’s ‘Oh well, you could have served this sentence while you were serving your previous fraud sentence, so we’ll just pretend you did. Naughty boy.”

    In a case of the shoe being on the other foot I know of a recent case where the home owner ripped off the roof painter.

    Independent painter working as a 2nd hustle hired by a prominent local couple with a number of cottages on the beach side in Paget.
    Tried to make up all sorts of BS excuses which a little investigation proved were all lies and then paid the poor guy only a third of what he was owed . And the rate was a bargain in the first place !

    Roof and House painting is used by many scammers to get money,even IF they do actually paint anything,it’s usually a very poor job.

      Always though it was “If you want it done right do it yourself” but yea I’m glad my pops told this guy to f*** off (in a much nicer way) last time he offered his services or lack thereof. I bet everyone wants to hire him now…no wait, no one will hire you now you f**** idiot. Like roof work is so hard. You can make close to 2grand a week doing it by yourself…properly. most people would kill for 8grand a month and yet again the justice system fails and the victim loses. SMH another day in the isle of devils.

        I guessed too! This guy has been doing this for years. Most victims cannot follow up on his tricks. That sentence is ridiculous; where is the justice?

    This guy has repeated this same scan numerous times. I know of another person he scammed for $1000 “to buy materials” to paint the roof and then he disappeared. No painting done and no money returned. And he is known to have a drug habit and bad temper.

    Just be wary of him and don’t hire him if he comes to your door. I personally agree that he be given a fine and pay back the victim rather then be housed at the tax payers expense……

      Depends on if the work is actually done, or not, as the case may be…….. and of course on the size of the roof, assuming the work is actually done.

    Just last week some guy offered to paint my roof for $2500 – and wanted me to put down $1200
    I told him that my younger Cousin and I generally do it every four years – after that he persisted that if he done
    that day I would get the deal — when I told him no twice he became angry and called me all sorts of names and
    walked off.
    What he didn’t know was that [1] he is a Drug addict [2] he has successfully done this before and he has been to Prison
    several times for dumb stuff like this.
    There’s a lot of tricksters out there – your just got to know them.

    Soooo….he served 3-4 months out of a 6 month sentence for scamming before. Who knows how many others he has scammed. The very next year he is back in court for the very same offence & the judge this time thinks it is a good idea to give him a two for one & backdate it. He walks out smiling. He got nothing but a further note on his record. A real deterrent.

    What planet do these Magistrates come from? Bermuda truly is another world.

    Painting a roof correctly, is not as easy as painting a wall. It is also fairly dangerous, especially if it’s slippery. I do mine, still, but now, I have to get help, as I am now over 60. Another solution, is to get the materials yourself. Also you can contact Age Concern. They have a list of reputable business-men who you can hire.

    Use a reputable company who has been around for a while. Word of mouth also works well! If someone has done a good job, tell EVERYBODY you know!
