OBA, PLP, Police & Paradise On Betting Matter

The Bermuda Police Service, Paradise Games and the Progressive Labour Party have commented on the matters surrounding the police inquiries into the newly opened Court Street betting shop, while the One Bermuda Alliance said as it is a police matter they will not be commenting.

Paradise Games — which is owned by PLP Leader Marc Bean — was visited by the police last week Friday.

Paradise Games defended itself against a report which indicated they may be illegally selling lottery tickets, the PLP said the matter ”raises questions about political interference and abuse of power,” while the Police said they are an “apolitical organization” and “political wishes do not feature” in their decisions.

Paradise Games said they are “in strict compliance with Bermuda laws in that it receives and negotiates bets under fixed odds for all games offered in the establishment.”

The company said, “Paradise Games is a betting shop licensed by the Betting Authority and governed by the Betting Act 1975 under the laws of Bermuda. Paradise Games offers its customers the option to make fixed odd bets on number games held abroad

“Pursuant to the Betting Act 1975 [PDF], for the purpose of this act, a bet shall be a fixed odds bet only if each of the persons making it knows, or can know at the time he makes it the amount he will win, except in so far as that amount is to depend on the result of the event or events betted on or on any such events taking place or producing a result, or on the numbers taking part in any such event, or on the starting prices or totalisator odds for any such event, or on there being totalisator odds on any such event, or on the time when the bet it received by any person with or through whom it is made.”

“Paradise Games at no time has held themselves out as a seller or an authorized agent of Florida Lottery tickets nor does Paradise Games sell or provide Florida Lottery tickets to its customers.

The company said they accept a “fixed odd bet on Florida Lottery Games for the further consideration of a Florida Lottery ticket to be generated by an authorized Florida Lottery dealer. This dealer [retailer] is FML Web Shop, which is listed on the Florida Lottery website.”

“Paradise Games then provides the customer with a receipt evidencing the funds received and listing the numbers for transfer to the authorized dealer for the generation of authorized Florida Lottery ticket. All Florida Lottery Games are based on fixed odds, which is consistent with our license and permissions granted there under.”

Civil Action

The initial report on Friday night from ZBM said they understood the Police visited the betting shop that day amidst allegations of lottery ticket sales, and another report by the Royal Gazette indicated that Paradise Games may be illegally selling Florida lottery tickets.

Paradise Games was critical of the newspaper’s report and indicated they have “given instructions for a civil action to be filed” against the Royal Gazette “for damages and losses [past and future] based on the negative effects and damage caused to our groups global expansion strategy.”

While not directly responsible for the newpaper’s editorial content, the CEO of Bermuda Press [Royal Gazette's parent company] Mr. Jonathan Howes said he stands behind the staff and the story as reported.

Progressive Labour Party

A separate statement issued later today by the Opposition said, “The recent action taken by the Bermuda Police Service and the DPP in relation to Paradise Gaming have created a politically untenable situation that raises questions about political interference and abuse of power.

The PLP said that they “understand that community intelligence led to the Police to attending the PLP Leader’s new business last week and alleged that the “so-called community intelligence originated from two senior OBA Cabinet Ministers” and was “disseminated” to the media.

“We further understand that despite offering similar lotto games as other betting shops that have operated in Bermuda for decades, no other business was targeted for legal violations. In fact the one currently located directly across from the police station has not been investigated,” said the statement from the PLP.

The PLP continued, “We are informed that Acting Commissioner of Police, Mike Jackman, an officer known for upholding high standards of discipline, was not aware that an officer had been sent to the PLP’s leader’s business until after the fact, at which point he received a briefing.

“About two hours prior to the police attending Paradise Gaming, PLP Senator Marc Daniels was searched by a police officer based on ‘community intelligence’ that a client of his had been threatened. Later the BPS described it as a ‘misunderstanding.’ Interesting considering the timing.”

The statement from the PLP said this “smacks of political interference,” and also said the “OBA know no boundaries in their attempt to attack and discredit,” saying that Minister Wayne Scott “insinuated” that the Opposition Leader was engaged in money laundering.

Speaking during the Motion to Adjourn on Wednesday [Mar 12], Minister Scott referenced the report about Paradise Games, and asked: “Isn’t that money laundering in this country….that’s illegal.” He subsequently withdrew the comment after the Speaker interceded.

Bermuda Police Service

In response to the PLP’s statement, Acting Commissioner of Police Mike Jackman said, “The Bermuda Police Service is an apolitical organization that is governed by very clear obligations and responsibilities laid down by the Bermuda Constitutional Order and the Police Act 1974.

“Political wishes do not feature in our decisions and I wish to assure everyone that this particular case was not directed by any political imperative,” added Mr. Jackman.

“We have already made a statement about preliminary enquiries into the business activities at some betting shops in relation to lottery tickets. Those enquiries are not limited to one shop.

“To date, officers from the Central Community Action Team have visited four betting shops in Hamilton to check compliance with Section 2 of The Lotteries Act 1944 [PDF].

“Those findings have been communicated to the DPP and the Bermuda Police Service is taking legal advice on whether or not any offences have been disclosed at any of the businesses.”

“I also acknowledge that Senator Daniels was searched by our officers. This resulted from an error in judgement by a supervisor and not as a result of a directive from senior officers.

“The officer has apologized to Senator Daniels and this was followed up by a senior officer who apologized on behalf of the Bermuda Police Service,” concluded Mr. Jackman.

One Bermuda Alliance

When asked, an OBA spokesperson said, “This is a police matter. The One Bermuda Alliance is not prepared to make any statement about it.”

      If you are talking about Three Crown and their offering of the Caribbean lottery, the cases are completely different. Indeed, Three Crown is an authorized dealer of tickets for the Caribbean Lottery. As I understand, Paradise Games is *not* authorized* to deal in Florida Lottery tickets.

      At any rate, shouldn’t Mr. Bean be held to a higher standard than “everyone is doing the same thing,” so why shouldn’t he?

        Good point, I would add that Mr Bean isn’t actually selling lottery tickets, they have circumnavigated that prohibition by selling you, as I understand their explanation, fixed odds that a ticket they bought is a winner. This means if they are offering fixed odds of 100:1 on a ticket, you give them $10 and that ticket turns out to be a million dollar winner, you get $1,000, they get $999,000. And they didn’t even pay for they ticket.

          Where has it been stated that Paradise Games make anything off a winning ticket? You’re ridiculous, posting this false information. They simply transfer the numbers you bet to a LICENSED agent (their partner) who then purchases, and stores your ticket. At Paradise Games, I was given an order ticket (as you can see in the royal gazette article) that shows the numbers I played. when I questioned how id receive the millions should I win, the manager simply replied “you would have to visit our partner in Florida whom you purchased your ticket from, with the order ticket you received here, they’ll provide you with the winning (legal) lottery ticket, and you collect your winnings (subject to state tax)”. They take nothing from the winner. If your numbers come up, you win twice as you placed a bet on those numbers with paradise games, and you win the lottery from Florida. Any foreigner can win a major USA lottery, they’re just subject to an increase in tax.

          You clearly know nothing of the shop, or how they work and should be embarrassed at how you’re acting, trying to attack Mr. Bean and his business with the fiction you’re posting. Your messing with a mans business, which has all Bermudian staff.

          Go to Paradise Games shop and see for yourself instead of speculating based on a biased article. Hence why they said “may” be. using information based on anonymous tips received over the phone. Pathetic.

            I am willing to bet that Marc beans lawyer is cringing after reading what you just wrote!!! Everything you said in your first paragraph is illegal in Bermuda!! Selling lottery tickets in BDA is illegal and it is already been confirmed by the Florida lottery that paradise games is NOT a licensed agent of theirs and the tickets sold by Paradise are NOT recognized by them either!! So there is no way of you collecting your millions of dollars in winnings!!! The only winner was paradise games, until they got caught of course!!!!

            So you are saying that Paradise Games is a charity organization, that is operating as a not for profit. That they go through the expense of being an intermediary for purchasing for free.

            I will admit that my 100:1 odds was there for effect, it would be interesting to find out what odds they do give, but that doesn’t change the model of how they avoid to actually sell you a lottery ticket. It does change that they are going to make money on sending your money overseas, where the odds are it will never see these shores again. Whether you win or lose the lottery, Mr. Bean is in a business to take money out of the local economy

              As for @build a better bermuda. As far as im aware . they offer other games in which they can generate profits. I think you guys need to visit the shop you’re trying to discredit.

                  I also say let the chips fall were they may on the Premier Cannonier lawsuit, I have always said who ever is found to be guilty in this lawsuit should step away from public life for good!!! Now onto the Paradise thing, what Paradise is doing is without a doubt on they grey area of the law, also I think that anyone that is conducting himself like this, especially a possible Bermuda Premier one day should cease and desist!!! How on earth can we trust a person that pushes the boundaries of the law??? Keep in mind that I still think he is breaking the law but I am neither an attorney, DPP or police so I will leave it at that!!!

        While the PLP had nothing to do with the public loss of trust and faith in the OBAubp, they have seem to overlook why this has taken place. It was due to their own doings, of showing the public who they really are. The OBAubp failed to show the public that they are government whom is TRANSPARENT, TRUSTWORTHY, and HONEST. Folks have seen this over and over again. Today’s actions by the government reveal this even clearer.

        This is very scary to the OBAubp, as a result they will find ways to attempt to sink the PLP. The battle has been lit by the OBAubp.

        But the PLP will continue to remain standing strong, as folks see the behaviours of the OBAubp and are turned off even more. Keep pushing on this strong Opposition, it takes a lot to break the backs of the powerhouse PLP…..…and it is killing the UBPoba ……let them keep moving the chess pieces…..the final one will come sooner , rather than later…..lol

    I would like to thank the acting commissioner of police Mike Jackman for making it clear that there was no political interference!!! Also I would like to say that maybe it is time for the opposition leader to step down and spend his time trying to clear his name, he now has a lawsuit launched against him by Prem Cannonier for defamation and now the police are investigating his business!! I am starting to see a pattern here and it is very similar to the last 8 yrs of the plp reign of terror!!! Now I ask, can anyone support the plp and their leaders in good conscience unless these situations are dealt with and proven false?? My money is on they will NOT be proven false and hopefully the justice system will do its job for a change!!!!

    A betting shop is set up on the fact that more people will lose more money than win, that is why they say, ‘the house always wins’. They don’t actually provide the community a beneficial service for the monies they take from it, just the slim chance that someone might beat the odds. They position themselves to sell false hope to those who can least afford it. Those that own and run betting shops are out for one thing, taking money from people without having to actual produce a product or service.

    So what does that say about the character of the leader of our opposition, who wants to be in charge of our country’s money.

      Hotel Casinos are set up under the same premise but are even more of a danger to society than betting shops because they bring about more chances of along with gambling addiction, substance use disorders, mood & anxiety disorders, or personality disorders. They also have been proven to influence increases in suicide rates, narcotics dealing, theft, prostitution & money laundering. I don’t think any of our politicians shadow or current government that promote any type of gambling are for building a better Bermuda. At least Bean was honest enough to show his spots with his government contracts speech while others still purport to have Bermuda’s best interests in mind.

If you read and comprehend the statement released by Paradise Games you can see that they don’t sell lottery tckets, only transfer the numbers you wish to play in the lottery to the Licensed Florida Lottery Agent (FML web shop) and they purchase the lottery ticket for you. Paradise Games offers you an order ticket/receipt indicating that your numbers have been given to the Licensed agent and they have purchased your Loterry Ticket. The statement clear says that.         Actually Rick has recently defended the “Term Limits” that PLP had set up which the OBA was quick to dismantle by stating they were one of his main influence to hire a full local staff. He has also provided proof that Bermudians are willing to work long hours despite the prejudice spouted by many that Bermudian’s don’t want to work those shifts so foreigners must be hired.     So the Police clearly say they are looking at more than one establishment, i’d trust them over Mr. Bean on that part of his faux outrage. Secondly i see a lot of mentions about the Betting Act but none of the Lotteries Act which states in Sec 2, which is what the Police say they are looking at, says:

    Lotteries prohibited unless deemed by this Act not to be unlawful
    2 (1) Subject to subsection (3), any person—
    (a) who promotes or conducts or attempts to promote or
    conduct a lottery within Bermuda; or
    (b) who causes or procures or attempts to procure any other

    connection with any lottery promoted or proposed to be promoted either

    Now look at the Paradise Gaming Facebook page and the posters they had up until last week which talk about winning $270 million and mega millions and tell me it doesn’t fall under Sec 2 (c) (iii)

    Everyone needs to relax, this issue is not bigger than the issues the island is facing. It pales in comparison to those issues. But yet you waste energry on the issue to make Marc Bean and his legal operation to seem less credible.

    It seems to me that reading the comments, there are only two possible explanations for this:

    - The OBA, police and Governor are colluding against Marc Bean.
    OR
    - Marc Bean’s enterprise is unlawful and the police were only doing their job following up on concerns expressed to them.

    If the choice is framed like this, I can tell you instantly what sounds more credible to me, especially when you deal with betting shops which already operate in a nebulously gray area of the law, given Bermuda’s schizophrenic approach to gambling.

    Sure, there’s a third possibility that lies in the middle. Maybe the person who spoke to the police was politically motivated, and the police, in doing their job, are simply following up on such a tip. No need to bring collusion into the mix or to malign the reputation of the police.

    But even so, notwithstanding the motivations, so what? People are people and motivations for calling the police are never pure and are often self-interested. Perhaps a competitor is looking for a leg up, or a scorned lover seeks vengeance. At the end of the day, due process exists to filter these tips into actionable investigations and court proceedings. Surely the police would have regarded the tip as sufficiently serious to warrant following up, and Mr Bean and his partners will be entitled to all legal and procedural rights that exist to vindicate himself?

    The reselling of state run lottery tickets out of a state let alone outside of the country maybe a violation of State and Federal laws.
    This could get Bda in trouble with the U.S. just what we need more scrutiny from the U.S. authorities.
    This operation more than likely has a U.S. partner who is purchasing the tickets so that the numbers are in the lottery system.They must be taking a cut or charging more then a dollar per ticket as they would not be doing this for charity, especially with the logistics involved.

    Lets say 1000 people purchase a “$3.50″ ticket.
    That’s $3000+ in the till if no one wins.
    Now if you buy 10 tickets or 20 tickets……….

    It’s a scam and easy money.

    The purchaser in the US would probably take the ‘lump sum’.

    After taxes would keep a major portion for work done and you may end up if your lucky with a few mill. Then the monies are in the US and how you gonna get it back to Bermuda.

    And it’s up to almost $400 million or shy.

      Have you taken into account the legality of this whole thing from a U.S. stand point? Drawing more attention to Bda from U.S. authorities possibly hurting are relations with the U.S. and our pre-custom clearance arrangement and in addition questioning our reinsurance industry which we are always a target of U.S. politicians.
      On the other hand,you are financing the educational and U.S. state operations with Bermuda money that could stay on the island and finance our operations.
      Higher the jackpot,more the odds against you.

    First, many State lotteries have residency and age requirements. It would be interesting to know if Bean and co are on violation of any Florida laws as well as the local ones that may have been broken .

    Second, this whole thing is very seedy and surely someone who wishes to run the country can find more wholesome ways to make money, even if it is just pumping gas. Betting shops represent a seedy underbelly of our society and Bean’s involvement speaks volumes. Is he really this greedy?

    things like this are usually just distractions so that you don’t pay attetion to the real problems of bermuda. I wish i would see more comments on positive articles about the good things happening in bermuda, this is not the only betting shop in bermuda and you don’t need to go to a shop to place your bets and or lottery tickets. The internet puts all of these vices at your fingertips, and the internet helps educate/confuse us as well.
