So the Magistrate’s sentence actually ENCOURAGES rather than deters this escape hatch/technique!– as simply ‘the cost of doing illicit business’! Sad! Hope the Crown appeals as the last thing BDA needs are Magistrates indirerectly encouraging the drug trade!!

They can only sentence him on what they can prove, they found no drugs so they can’t sentence him for drugs. Since it has never been proven that it was indeed drugs that he was trying to import it’s only your opinion that drugs were involved & a person shouldn’t be convicted on opinion alone. Do I think drugs where involved? More then likely but just like you it’s only my opinion not what I can prove.

ok…so…there was really no case to answer to except, running from a customs officer…$2,800 for running…hmmm…i hope the fine was sufficient enough to cover the cost of this case, if not…then i suggest the incompetent border patrol agent, holding a position encompassing national security be footed with the bill.
