From what we ( the public ) understand, the medical records were seized as evidence a lawsuit that the former ( OBA ) Government filed in a Massachusetts court against BHCS / Lahey Clinic. The case was dismissed on March 8, 2018. The ruling judge said that “Bermuda has not shown that it suffered any injuries in the United States as a result of the alleged scanning scheme.“

So what reasoning are the police using as justification for holding on to these medical records? They should release the records posthaste otherwise they are exposing themselves to a potential lawsuit.
