Guilty Plea: Obstruction & Resisting Arrest
32-year-old Raymond Burgess, who had been sprayed with Captor spray and then Taser’ed, this morning [May 9] pleaded guilty to three charges.
The three charges, obstructing Police, assaulting a Police officer, and resisting arrest; stemmed from an attempt by Police to search Mr Burgess after Police had formed the opinion that Mr Burgess might be in possession of drugs and attempted to search him under the Misuse of Drugs Act.
The incident occurred yesterday [May 8] in the Swinging Doors nightclub on Court Street. Mr Burgess said that he had indeed placed his hands in his pockets, but had done so in order to empty his pockets and show Police that he had no drugs in his possession.
Police evidence was that inside the nightclub, Mr Burgess had moved away from Police and had offered resistance to the extent that Police found it necessary to first use Captor Spray in an attempt to deter him, but had then been forced to use a Taser strike in order to effect an arrest.
Police evidence was that Mr Burgess was then taken to the Police Station and thoroughly searched. No controlled drugs were found on his person or in his possession.
Mr Burgess, who was said to be an Assistant Manager at C&R Discount store, said that he was a relative of a man who had recently been shot and killed on Court Street which had caused him distress. His brother Troy “Yankee” Rawlins was gunned down in August 2010.
Magistrate Warner fined Mr Burgess $600 on the obstruction charge, $500 for resisting arrest, and $500 for assaulting a policeman.
