Regiment Releases Absentee Soldiers Names
The list below was released by the Bermuda Regiment, and contains those soldiers who are recorded as long term absentees along with their last known address. Anyone having information as to their whereabouts or circumstances is requested to contact The Regimental Sergeant Major WO1 Rayner at 238-3921.
The Regiment noted that in some cases, soldiers who repeatedly fail to turn up for duty are prosecuted in Magistrate’s Court and, if found guilty, they can face a large fine and imprisonment.
“It’s in everyone’s interests for people with outstanding time to serve in the Regiment to do something about it, rather than just hoping the problem will go away – it won’t,” said a spokesperson.

A couple of these guys are over the age limit for conscription, I mean one of them was born 1977! How can he be made to do the regiment if he’s 35 or 36? Someone better tell that new commander of their’s that there is an age limitation.

Why would we want to help the regiment imprison people!? It is not in my best interests nor the general publics to turn in these men. It is upto the regiment to deal with it themselves, not to get the public involved. It has nothing to do with the public that they cannot control their own recruits. Why do these people not want to be there? That is the main issue.

According to the Defence Act 1965 part II section 17A:
“Requirement to serve if selected for military service
Notwithstanding anything in this Act contained, any person selected for military service under this Act shall be required to serve in the regiment for a period of three years and two months:
Provided that no person shall be required to serve in the regiment after he attains the age of thirty-three years”
There are 20 people on that list above that are over 33 years old and by the law cannot be required to serve.

if you understood the defense act you’d realise that that 33 year old limit only applies to initially entereing the regiment, it doesn’t count if you skip for 10 years. Then again I’m surprised that they are looking for these guys, considering their budget cuts you’d think they’d spend the resources on something else. i did my 3 years, 2 months, 2 weeks and got out of there, that’s the easiest thing to do.
Actually I do understand the act very well… making sure Government departments are in compliance with legislation is the biggest part of my job. Any decent lawyer can argue once a man reaches the age 33 they cannot be forced to serve regardless if they have started their service or not. That being said they are probably only still listed due to the regiment’s complete ineptitude of compiling accurate data.
I do agree with you that chasing down 33 year old men is a complete waste of time and money when they should be focusing on (a) the young guys that could use the discipline and (b) providing a better service for Bermuda.

The heading of the section you quoted sums it up nicely- selection for service- obviously those on this list over 33 were selected for service prior to attaining that age…

My comment makes perfect sense if read correctly. It was based on the assumption that should the Regiment be successful in locating these men they would want them to complete their service. I never said they were incapable, the act states they are not required to do so. We in fact do not know for sure what the Regiment intends to do with these gentlemen if found, I was merely pointing out that they could not force the ones who have attained the age of 33 to finish their service if that is their intention.
if you can read properly it says you cannot be called up after the age of 33. Those people were obviously called up before but failed to complete their service. which is entirely sad and ridiculous because as much as Bermudians insult the regiment myself included there are alot of names on this list for a defense unit which in terms of defense region wide or even worldwide does absolutely nothing. the regiment in military standards is a walk in the park
If you read it accurately it says:
“Provided that no person shall be required to serve in the regiment after he attains the age of thirty-three years”
“Required to serve” means that they cannot be called up that’s true but it also means that if they have already been called up and they reach the age of 33 during their service they are not required to serve past that age. They can if they wish but cannot be forced to. This was confirmed by a Commanding Sergeant Major at the Regiment.
I think you’re reading way too much into the act. I don’t know how you are coming to that conclusion given the wording of the act.
Fuethermore, “Commanding Seargent Major” do not exist in the Regiment.

@SAJIL, yeah that was the first thing that went through my mind, but I think all this really is a money grab. If they get hold of any of the guys on the list they will get a “substantial fine”, which I’m guessing is probably a couple grand. The guys who are over 33, “and looking the list over again I see there is 38 year old on it), cannot be made to actually do the regiment but the obviously went up to Warwick Camp and signed up at some point, hence their ranks and numbers are listed, so they can still be fined. The joke of course is you know that none of these older 30 something guys names have been called up or had their names printed in the papers probably for at least a decade.

One story said their skipping the Regiment costs the Bermuda tax payer. Something about that does not seem right. How does me skipping the Regimaent cost money?? The reverse is probably true. If they do not serve, there is no need to pay them.

This is just some list on a computer up at Warwick Camp, do you think they even bothered to check if people on it were over 33 before they issued it to the press? That being said it would be good for a lawyer reading this article to chime in and tell us what the regiment can legally do if you are over 33.

Actually it isn’t. The Defence act is unmistakably clear in that once you reach the age of 33 you are not required to serve. PERIOD. It applies to enlisted men as well as men not yet drafted. It was specifically added to the end of the paragraph that lays out the length of service that is what “provided that” means in legal terms.
You are required to serve three years and two months “provided that” you are not required to serve past 33 years of age (if you don’t want to). Therefore if you have not finished your service and are now 33 years old you cannot be forced to.
There is no “holding on” it’s simply the facts. If you believe that it doesn’t apply to men already enlisted copy and paste the clause in the Act to back up your claim.

Sajil your interpretation of the law is flawed. You are reading a section that deals with service- again, age has no bearing for absent soldiers. These over 33 year old soldiers are absent, and therefore in breach of the Act and should suffer the penalty provided in the Act, which by the way isn’t service- nowhere does it say that persons listed have to report for duty…

I could be wrong on this one but I also heard that if you have a criminal record you cannot serve in the regiment. How many of these young guys have a criminal record. (gotten after being called up to serve) I see one on there that I know for fact has a criminal record.

You are correct, however, it is not up to the regiment to vet the individuals. That process is done by Gov. If any of the individuals listed now have a criminal record; more than likely they will be discharged from the regiment.

Yes, it is very legal. No different when names are published for recruits and no different when individuals appear in court and are convicted of a crime. These guys are breaking the law; thus, the info is made public.

If there is a list of names at the airport for non-compliance to conscription, then the same should be done for non-payment of child support and maintenance.
I used my I.D. issued by the regiment when I went to a gun range out in America so I could get a discount.
They man behind the counter argued that it was fake, and while I did say it was real, he said that all the fonts were different sizes and some were bold font and some were not and no real army would distribute such a unprofesional grainy innacurate I.D.
