ICO Decision On Office Of The Tax Commissioner

Information Commissioner Gitanjali Gutierrez has issued Decision 11/2021 in regards to the Office of the Tax Commissioner [OTC].

A spokesperson said, “On 7 October 2021, Information Commissioner Gitanjali Gutierrez issued Decision 11/2021, Office of the Tax Commissioner [OTC]. The Information Commissioner found the OTC did not respond to the Applicant’s request for an internal review within the statutory timeline required by the PATI Act. Because the OTC issued an internal review decision during the Information Commissioner’s review, the OTC was not ordered to take further steps.

“Decision 11/2021 reminds public authorities of their obligation to conduct an internal review and issue a decision within six weeks of the public authority receiving an internal review request, which is not extendable under the PATI Act.

“Decision 11/2021 can be accessed online at www.ico.bm, along with all prior decisions.”
