Guilty Plea For Theft & Escaping Custody
In Magistrates Court this morning [Apr.7], 43-year-old Delvin Stevens, who said that he was in the ‘Turning Point’ program, pleaded guilty to stealing $755 worth of phone cards and escaping Police custody.
The two charges relate to an incident on 7th February 2011 when Mr Stevens was in the Esso Collector’s Hill station and was caught, on CCTV, pocketing the cellphone cards. The Court heard from the Prosecutor that, later, on 5th March he was found by Police and they sought to arrest them.
However, Mr Stevens who was, at the time, riding a motorbike, rode off and eluded the police. He crashed into a wall, got up and was then chased on foot into the area near MAWI and Devon Springs Road where Police finally caught him.
As Police tried to place Mr Stevens under arrest, a group of men materialized, threatened the situation, and Police backed-off. Mr Stevens escaped. Later still, on 6th April, Mr Stevens was re-captured in the City and was taken to Hamilton Police Station where he was held.
With a guilty plea entered, and sentencing under consideration, there was confusion over whether or not Mr Stevens was on Probation having been released from prison in 2009. Magistrate Warner perused some Court records and said that this record showed that he was supposed to be on Probation until December 2011.
Magistrate Archie Warner then convicted Mr Stevens of the charges and ordered him remanded into custody overnight while matters of a previous Probation Order were sorted out. He will re-appear tomorrow.
