Court Dismisses Appeal In Senior Abuse Case
An appeal launched by Wendy Hayward has been dismissed, with the case now returned to Magistrates’ Court for sentencing.
In March 2024, Magistrate Craig Attridge had found her guilty of two offences of Abuse of Senior contrary to section 3[1] of the Senior Abuse Register Act 2008.
The document noted that both seniors were residents at the Sylvia Richardson Care Facility and the Ms Hayward was employed as a care worker at the facility.
One senior was described as “well into her nineties” and “suffering from advanced Alzheimer’s Dementia.” The court previously heard that Ms Hayward “jokingly” called the senior a thief, which made the senior “very angry and agitated” and the senior threw a vase at Ms Hayward.
The court previously heard a witness testify that Ms Hayward then slapped the senior, pulled her hair, poured water on her, repeatedly swung her wheelchair around from left to right, and emptied the contents of her purse over her head.
The other senior was a man in his eighties who also has “advanced Alzheimer’s Dementia” and a witness testified that the dependent punched him in his leg several times.
“I confirm my decision made on the 14th April 2025 to dismiss the entirety of the Appellant’s appeal and remit this matter to the Magistrates’ Court for sentence,” the ruling said.
