Police Make 27 Arrests: Warrants & Drugs
The Police have made 27 arrests recently for various offences ranging from warrants to possession of drugs.
A Police spokesman said, “Under the authority of Section 315F of the Criminal Code, the Police conducted Stop and Search checks in anticipation of violence on King/Union Street, Middle Road/Stadium Lane (Warwick Bowl), Court/Elliott Street, Glebe Road and One Way Deepdale and Parsons Road, Pembroke. As a result, 27 persons were arrested for various offences ranging from warrants to possession of drugs.”
A Police spokesman said, “A 28 year old Sandys man was arrested at Somerset Cricket Club on suspicion of possession of a controlled drug with intent to supply at 11:20 pm on Saturday April 2nd. After conducting a liquor license check, officers searched two men under the Misuse of Drug Act (MDA) and found a 28 year old man in possession of what appeared to be a rock like substance. He was conveyed to Somerset Police Station where he was detained.”
“Meanwhile a Pembroke man was arrested on Saturday night for having a small amount of plant like material in his car on Blackwatch Pass. Under Section 18 of PACE, PSU Officers with Canine Officers subsequently searched the man’s home situated at East Park Lane, Pembroke. As a result, ¼ pound of plant like material was found.”

I disagree True Dat. People need to start respecting the law. Not just one law, but all of them. In order to begin healing this country the police have to enfore basic laws. If people respect basic laws they are less likely to break more serious ones.
Easiest way to cut down a tree is from the bottom up, not the top down.
If the police only concentrated their efforts on serious crimes, new criminals are born into the system in the meantime and police then have to deal with an endless cycle. Stopping new criminals will help secure a safer tomorrow in the long term.
I admit there are more serious issues to deal with, but basic crime enforcement is part of the solution!

Many crimes have been solved by what you percieve to be a random “petty” search. If it was your house that was broken into, or your child that was shot … and the police were able to solve the crime by a “random petty or silly” search Im sure you would be first to ccal lthat officer a hero. I agree a broader plan is warranted but on the peripheral and based on the article, the police were in the areas of the arrests on the anticipation of increased violence. Purhaps the police presence and the arrests also acted as a deterent for whatever anticipated violence was expected.
I would assume the police force has the ability to split resources/personnel and concentrate not only on solving crimes but detering them as well.
If you haven’t noticed, a lot of the places they done “stop and search” is where these boys or “gangs memebers” hang to. Like court/elliot, deepdale one way, parsons road and union street! In addition, a lot of the issues with violence stem from “weed” and the like substances! So it is necessary for the searches to occur. Futhermore, there are different divions within the police department, hence, some of them are on patrol doing searching and the ones in the serious crime units and other units are working on the murders & investigations

True Dat I agree…however in some areas of te UK, Canada and the US they broke up the gangs effectively by getting them for anything and everything. If they spit on the side walk, littered, swore, not seatbelt, swerved across the yelow line, drunk in public…whatever….they arrested them. They harrassed the families and friends that harboured them and smashed down thier doors regularly until they gave them up or helped the police until they got results. Its the price we must pay for tru freedom.

I’m curious that all of these checkpoints are located in the central and western parishes of our island. This coincides with a report several weeks ago that approx. 85% of those stopped and searched happen to be black.
I’m not accusing the police of profiling (at this time), but is there any info related to whether they establish checkpoints in more predominantly white areas?
good question while the white drug dealer are smart enough as alway not to get involved in the gun play they are still drug dealers. I know some people are shocked to hear that remember we had a young man that was caught about a year or so ago with two guns and coke short memory people.

I live in Smiths and we have for years had to deal with a WHITE CRACK HEAD male who is now about 35 years of age that tries to break into people homes to steal cash to support his habit. When a home in my area gets broken into..and he is not in jail…who do you think we describe to the police as the suspect????
Linda, please have a read of the article again. These checkpoints do not yield results in terms of preventing drug dealing nor do they limit any gun violence. They never have and there’s a very limited chance that they ever will. They are only arresting people for warrants (mostly outstanding tickets) and mostly MINOR drug possession. White persons in this country are just as likely to have both, unless you live under a rock of course and think otherwise. Your penultimate sentence says a lot about you, so at this point it’s no use trying to convince you of seeing the other side.

Bermuda is actually about 55% black / 35% white so you can make up whatever stats you feel will help your story. With the true facts, there is a concern that they are pulling over more blacks than whites. If the police were constrained and had limited resources (something they cry about all the time), then yes, this would be smart policing. Unfortunately, I don’t buy their story since they frequently have the resources to harass the hardworking people of this country during morning rush hour. So if they have time to do that, they should have the time to police more areas of our community. Next time get your facts straight before commenting!

I CAPITALIZED SOME OF THE FUN STUFF.
From the Police Codes of Practice Code B as it relates to the PACE act:
1.8 Police also have powers to search premises without a search warrant. Such powers relate to searching premises either to make an arrest or following an arrest, or to seize articles found on premises that have not been searched under the authority of a warrant. They are subject to conditions and limitations, as to which see below. The main ones arise under sections 17, 18, 19 and 31 of PACE. In summary terms, they are:
a) section 17(1) – power to enter and search premises in order to:
(i) execute a warrant of arrest, or to arrest a person for an arrestable offence
(ii) recapture someone unlawfully at large; or
(iii) SAVE LIFE OR LIMB OR PREVENT SERIOUS DAMAGE OF PROPERTY.
b) section 18(1) – power to enter premises occupied or controlled by a person under arrest for an arrestable offence, in order to search for items that relate to:
(i) the offence for which that person has been arrested; or
(ii) SOME OTHER ARRESTABLE OFFENCE CONNECTED WITH THAT OFFENSE OR A SIMILAR OFFENCE.
c) section 19(1) – powers to a police officer lawfully on premises to seize any item, including a copy of material stored on computer, that the officer has REASONABLE GROUNDS FOR BELIEVING
(i) HAS BEEN OBTAINED IN CONSEQUENCE OF THE COMMISSION OF AN OFFENCE; OR
(ii) IS EVIDENCE IN RELATION TO AN OFFENCE
and it is necessary to seize the article in order to prevent it from being concealed, lost, altered, damaged or destroyed.
d) section 31(2)(b) – power to a police officer to enter and search any premises in which a person under arrest was found immediately before
he was arrested, for evidence relating to the offence for which that
person was arrested.
Now I do realise that for some of these reasons a person actually has to first be arrested. But take for instance the fact that 4 men where arrested and questioned almost directly after the latest murder. This means that up to 4 properties could have been instantly searched without warrant. Or take the case of Prince who was recently arrested for assault and making treats. His house could have instantly been searched without warrant under section 18(1)(ii).
Maybe some of these searches were done and we just didn’t hear about it.
My point is though that more doors can be banged in than are being done, but the police insist on stopping random people instead of painting targets on the people they know are troublemakers.
I’m very aware of the contents of the legislation. The original statement you made, states that the police can randomly go around banging in doors, simply because someone is affiliated with a gang. That is very definitely not the case.
All the instances you highlight do not support your original assertion.
Section 17 refers to something happening at that time. A reasonable belief that someone unlawfully at large or for whom there exists a power of arrest is within, or if there is a commotion etc consistent with a rapid need for police to get inside. Door cannot be breached cos a known gang member is inside.
Section 18, as you state, requires an arrest before it comes into effect so again is moot in your original assertion. I think the chances of these not having been done in this current case (and others) is nil.
Section 19 relevant wording; “lawfully on premises”. This more commonly refers to being on a drugs warrant and coming across a stash of potentially stolen jewellery. Removes the need to stand and wait while a second warrant is sworn.
Section 31 could be used I guess but it is intended, for example, for a person being arrested for drug possession and police believing he/she bought it from the address they just left.
So, I’m not pulling apart you thoughts, just making clear that knowing someone to be a gangsta is not grounds for police to kick their doors in, which is what you originally stated.
I obvisiously know that the cops can’t just go break down doors all willy nilly, but the law does give them more wiggle room than I think they’re using. Basically I feel that pulling stop and searches on a main road and at random is foolish. When they can instead directly target known individuals and then use PACE codes to conduct further warrantless searches. I just believe that not enough of this direct targeting is being done. For instances why aren’t stop and searches being done at known streetside gang hangouts? every day? sometimes twice?
Laws are always worded so strangely it can be hard for anybody, especially a layperson, of which I am, to really understand them. I highlighted that part of section 17 because even though I know that ‘life or limb’ must imply some direct immediate danger, the law does not specifically state this. There has to be someway of bullsh*tting around this! lol. lets get creative!!
At the risk of flogging a dead horse….look at where this article says the stops were done….classic spots where multiple shootings have occured or where, it is reasonable to assume, the perpetrators have travelled to and/or from the act.
I know they don’t bare much fruit other than weed and warrants but you can’t quantify prevention.
These stops have to be random, that’s the whole point and they move, regularly, because the drums beat quick here with BlackBerry Messenger etc.
But I do hear and understand your frustration. Trust me when I tell you that targetted operations are just hard to do here given the topography, small population and legal issues surrounding it.
Best way to find the source of the drugs and the dealers is to follow someone tha is addicted. Its not that hard they are all over the island and their lifestyle is predictable! Follow them for a day and they will lead you to their source!!!!

Sec. 17 Entry and Search without a warrant
An officer may enter and search any premises for the purpose of: Executuing a warrant for arrest, recapturing a person (who is unlawfully at large), saving a life or a limb.
Basically they cannot just go and kick down doors like we want them to.

ALl this madness has happened because these guys have been able to sell drugs and have been getting away for it and that lifestyle for a long time.
The guys doing all this craziness, their bread and butter is selling drugs,they dont work a regular 9-5 job.
The police need to destroy their income at any cost.After all these shootings Bermuda cannot go back to guys on the street peacefully selling drugs for a paycheck because we now know how violent the outcome can be.
Shame on you guys for not supporting this action,we need as much of this stop and search as possible,and if you ask me and a lot of ppl its not enough the police need to start breaking in doors 40 at a time and dragging these guys out of thier holes.From drug addicts to drug dealers,i guarantee you wouldnt hear another gunshot at all.
