Smith Recharged Over 2009 Southside Shooting
[Update - charges were dropped against Mr Smith in June 2011]
Before Magistrate Archie Warner, 25-year-old Kinte Smith was this morning [June 15] freshly charged with four charges relating to the Southside Cinema shooting that occurred on 13th November 2009.
The fresh charges arose because of a late afternoon decision on Tuesday 13th June in which Supreme Court Justice Carlyle Greaves had quashed an earlier ‘bill of indictment’ that the DPP’s office had laid against Mr Smith.
The effect of the senior Court’s decision was to eliminate or quash the charges on which Mr Smith has been held on remand.
In Magistrates Court this morning, Prosecutor Ms Cindy Clarke laid four fresh charges as the start of a new case. The first two charges were that on 13th November 2009, Mr Smith had allegedly and unlawfully attempted to cause the deaths of Shaki Minors and Renee Kuchler.
The third charge and allegation was that Mr Smith had unlawfully possessed a firearm, and the fourth was that he had unlawfully possessed ammunition. Both the firearms and ammunition charge relate to the 13th November 2009. Because all four charges are indictable and can only be tried in Supreme Court, Mr Smith was not required to enter a Plea.
Mr Smith, represented by lawyer Marc Pettingill, was remanded into custody until 21st June 2011 when he will re-appear in Magistrates Court to undergo a Short Form Preliminary Inquiry.
