Man Charged: Stealing From Nursery School

In Magistrates Court this morning [Sept.19], 53-year-old Warwick resident Richard Allen successfully argued against Magistrate Warner’s decision to remand him into custody until a 5th December trial on a charge of stealing $4,750 from Treetops Nursery in Paget.

Mr Allen had been charged with trespass and stealing $4,750 in cash from the Treetops Nursery and Daycare Centre, and had pleaded not guilty.

After accepting Mr Allen’s not guilty plea, Magistrate Warner set 5th December 2011 as the trial date and ordered that Mr Allen should be remanded in custody until then.

Mr Allen registered a strong objection to the Magistrate’s ruling saying that he was working, had a place to stay, and should not be sent to Westgate as “that place was bad for him” and he was “too old to go to jail.”

He asked that he bailed and released. Initially making and sustaining all of his own arguments, Mr Allen was then assisted by Duty Counsel Mr Leopold Mills.

Magistrate Warner then changed his remand ruling and granted Mr Allen bail in the amount of $5,000 with one Surety.
