Man Asleep In Parked Car Convicted, Fined
Truck-driver Levar Jones, 35, kept his truck driving privilege after being convicted of being in care and control of a motor vehicle whilst impaired by alcohol, with the Court hearing he was found asleep in the car.
Duty Counsel Charles Richardson argued for Mr Jones and pointed out that Police evidence had not shown that Jones had moved or was even planning to move the car.
Police evidence read to the Senior Magistrate was that Jones was sitting in the driver’s seat of a parked car and that the keys were in the ignition. He was said to have been asleep in the car in a bus stop in St David’s.
Mr Richardson said that in this case, Mr Jones earned his living by driving a heavy truck and, given the total weight of evidence, should be allowed to at least retain his truck driving privilege as so he could keep his job.
The Senior Magistrate Archie Warner ruled that Jones should be fined $800 and disqualified from driving all vehicles – except heavy trucks – for the next twelve months.

I agree confused I don’t understand what the big deal is. What eles was he to do? Drive it home? I think he did the right thing. Maybe he didn’t know anybody that stayed in st.davids and didn’t have the cash to catch a taxi.

How do you think the car got there? Did it fall out of the sky? No, it was driven there. So I guess you’ll argue that the defendant drove the car there sober and then got drunk in the car after he got there. And I have a used bridge in St. David’s to sell you too!!!!

Am I the only person who thinks that that whole “your technically still drunk driving even though the care is parked, yet the keys are in the ingition is so stupid?” The guy should be commended for pulling over and sleeping it over, instead of being charged..
No, I agree with you. My boy was charged for the same thing while sitting in his car waiting for the designated driver to show up, his keys were in his pocket, but what if I want to listen to the radio or play my own music while I wait? The police wonder why they don’t get much public cooperation?

That should be easy then. Main routes out of Hamilton on a Friday night and breath test everyone. Think of the revenue from the fines.

Might as well get rid of the care and control whilst drunk law then…supposed to be equivalent to drunk driving…except if you can prove you had no intent on moving, which defeats the purpose of the law of care and control…and you wonder why drunk driving is more of a sport than a hazard here

There is something that doesn’t add up here. How did the car get to where it was? Was the driver sober and then got drunk after he arrived there where the car was parked? I guess one could argue that he got in the car, decided that he was too drunk to drive, put the keys in the ignition and went to sleep.
I thought that if you are drunk in the car and the keys are in the ignition then you are in care and control of that vehicle. Many have been convicted of drunk driving in the past for just that, but the posts here seem to think that that is not the case. Some even have the audacity to make humour of it. The posters seem to think this is no big deal. As long as this “drinking mentallity” continues to effect Bermuda we will see a lot more deaths on the road. And I hope it isn’t any of these poster’s children, relatives or these posters themselves.

Why is it that you find many in a similiar situation such as Mr. Jones n were disqualified from operating an electric toothbrush. So how does Mr. Jones keep his licence for heavy trucks n there were others whom made similiar request to retain their licence because of their employment n was totally denied. Can someone who has their head screwed on right n tight, explain what the hell is wrong with this picture. Racism is found in areas where it is least expected. Our legal system has skeletons in its law n what’s good for the goose is good for the gander. What a brazen slap in the face for many whom have made the same plea. I drive for a living……”Judge…now you walk”. Unfair decision n needs to be revisited as there are others whom lost their jobs n now probably can’t find. Blind justice.
