Suspended Prison Sentence For Third DUI

Appearing in Magistrates Court, a 47 year old man received a suspended prison sentence after pleading guilty to driving whilst impaired, marking the third time he has been convicted of the offense.

Senior Magistrate Archie Warner handed down a three month prison sentence to Roger Spencer, levied a fine of $2,000, and disqualified Mr Spencer from driving all vehicles for three years.

The Magistrate suspended the 90 day sentence for two years, warning Mr Spencer that any conviction occurring in the next 24 months could result in this prison sentence being activated.

Mr Spencer’s record indicated that he had last been disqualified from driving in March 2013 and had only come back on the road on 14th September 2014; that this March 2013 disqualification had been for driving whilst impaired; and that there had been a previous driving whilst impaired conviction.

The Magistrate told Mr Spencer that because he also had thousands of dollars in unpaid fines, he would have to pay $1,500 in fines immediately or remain in police custody. The Magistrate gave Mr Spencer until 25th October 2014 to settle the balance.

Mr Spencer was also fined $100 for having no valid driver’s licence.

    Isn’t this kind of an insult to all the responsible people who don’t drink and drive?
    Throw his a** in jail and give him some time to think about how stupid and irresponsible he is.

      The scary thing is this guy CLEARLY has no regard. Not only 3x DUI offender, but no valid license, and thousands of dollars in unpaid fines.

      When he eventually injures or kills someone else (which is the obvious conclusion anyone with half a brain would draw), they should lock up Archie Warner for a long time!

      Now how is he going to earn any money to pay the fines if his backside is in jail doing time at our expense? He will lose his job. Then what? There are plenty out there who have not paid fines.

      Make Saturday community service day. Dress them up in bright orange jump suits & send them out to clean the roads & beaches at the equivilent of a minimum wage to pay off their fines.

        It needs to be made absolutely clear to everyone that DUI, multiple times, is intolerable. This guy has absolutely no regard for DUI laws. Let it continue, and he will kill someone.

        I actually agree with you. It’s easy for people to just pay a fine and be done with it. It would punish them more having to give up their free time doing community service.

        I’m with you Triangle Drifter…far too many $ have been pi$$ed into the winds for labour that can be / should be done by them on their days off from work. This is a win win system to adapt to. People can pay off their fines or for child support that’s in arrears. Why must we,(the Govnt) waste so much money on this type of “character”?.

        You are being far too lenient!! Let the punishment fit the crime (for a 3rd time offence)!! And with this DUI crime – innocent people DIE!!

        You would take a completely different “viewpoint” if this clown had killed one of your family members – because he was “drunk” behind the wheel!!

    If he didn’t learn his lesson the first time then the continued disrespect and irresponsibility towards the lives of other road users clearly demonstrates that he should have been locked up for at least two years.. none of this ‘suspended’ nonsense.

    It sounds like he’s only going to do it again as soon as he comes back on the road . That’s if he doesn’t choose to drive whilst disqualified. He’s obviously that dumb.

    Where’s the community service? Send him to KBB and let him clean up on the side of the road and be ever fearful of someone LIKE HIM coming around the damn corner. What a joke of a sentence!

    Clearly he’s not learned his lesson from the previous DUIs – a three year driving ban and $2K fine doesn’t seem adequate at all.

    Why is this allowed? I’m sorry but 3 strikes and you’re in jail. What was Archie Warner thinking — or was he thinking at all??? With all the pushing to get drunk drivers off the road, this is what we get from our court system? Really Mr. Warner????

    This magistrate needs to hurry up and retire. A few days ago he threw a grieving grandmother in jail to “help” her with her alcohol problems.

    Her crime was stealing a $3.99 slice of pizza.

    Yet this guy, who could have killed somebody with a deadly weapon (his vehicle) gets a suspended sentence.

      FYI. The lady was not locked up for stealing a $3.99 pizza it was for admitting to tresspassing 2 times when she had a “No Tresspassing” order.

    A guy like him needs to be off the road. Imagine if he hit an elderly person walkin across the street or even a bunch of kids walkin home from school. That 1 lil mistake driving or riding can cost a life

    I think the guy should start attending AA meetings. Whilst making no excuses for this guy’s bad behaviour and noting too how lucky he is not to have been jailed, yet again it’s the small guy taking the fall – don’t tell me for a second that lawyers, politicians, doctors, contractors, etc don’t ever drive around half, even full hot but when was the last time someone prominent hot hauled up for this?

      Compelled to having to attend A.A. meetings should be a part of all who are convicted of D.U.I. of drink / drugs, (alcohol is a drug!) sentence as oppose to a slap upon the wrist :-(

    This is a joke.
    This is also a prime example of why drunk driving is so prominent on the roads of Bermuda.
    This gentleman has been back on the road for under TWO WEEKS for an offence (his second to be exact), that had his license suspended for 18 months!!!
    What are we missing here?
    How is it possible that this guy isn’t locked up?
    The parity of sentencing in our courts is appalling….

    That’s crazy… This guy should be in “jail” for 3 to 6 months as he is NOT bothered about being a very real danger to-the-public and thinks he is above the law!! People “DIE” due to idiots like this!!

    In Arizona (and other states) he would be serving a MANDATORY 6 month jail term!! They do NOT mess around over here!! Also, double his annual vehicle insurance premium!! Some people have to learn the hard way!!
