Court: Four Charged Over PLV Loan Funds
Four people have been formally charged with criminal offences in connection with the failed Par-la-Ville hotel development.
Former Mayor Graeme Outerbridge, Corporation of Hamilton Secretary Ed Benevides, developer Michael MacLean and his wife, Yasmin MacLean, all appeared at Magistrates’ Court this morning [June 27] where the charges were read.
Mr Outerbridge, Mr MacLean and Mr Benevides are charged with dishonestly obtaining property, namely $15,449,858, in October 2014 belonging to Mexico Infrastructure Finance Ltd [MIF] with the intention of permanently depriving MIF of their property and falsely representing to the Bank of New York Mellon that the terms of escrow agreement had been satisfied and the release of the funds was thereby sanctioned.
In addition, Mr and Mrs MacLean were charged with, that between October 2014 and November 2014, they allegedly stole $13,749,858 belonging to MIF with the intention of depriving MIF of the money.
Secondly it is alleged that between the same dates they used money, knowing the money was in whole or in part the proceeds of criminal conduct.
Mr Outerbridge is also charged with corruptly agreeing to obtain property for the benefit of Mr and Mrs MacLean while holding a public office by omitting to follow the terms of the release of the property and authorizing the release of $15,449,858 held in escrow in account “Par-la-Ville Hotel and Residences” at the Bank of New York to the personal account of Mr and Mrs MacLean.
Mr Benevides is also charged with agreeing to obtain property for the benefit of Mr and Mrs MacLean on the same date as Mr Outerbridge.
The defendants were not required to enter pleas to any of the charges today because the case will be heard at the Supreme Court.
Magistrate Khamisi Tokunbo granted the defendants on $250,000 bail and ordered that each provide a like surety.
The will appear at Supreme Court Arraignments in September.
