ICO Decision On Department Of Internal Audit
The Information Commissioner Gitanjali Gutierrez issued a decision regarding the Department of Internal Audit that the Public Access to Information [PATI] Act 2010 did not apply to the requested record.
A spokesperson said, “On 19 July 2019, Information Commissioner Gitanjali Gutierrez issued Decision 19/2019, affirming the decision by the Department of Internal Audit that the Public Access to Information [PATI] Act 2010 did not apply to the requested record. The requester sought the report completed on 14 December 2018 by Internal Audit about the allegations of misconduct against the Director of Child and Family Services.
“In Decision 19/2019, the Information Commissioner has found that Internal Audit correctly decided that the report fell outside the scope of the PATI Act in accordance with section 4[1][b][vii] of the PATI Act because it was created by Internal Audit in the course of carrying out its functions.
“Specifically, having reviewed the report and the submissions by Internal Audit, the Information Commissioner has found that the report was created by Internal Audit in the course of carrying out its functions under section 4 and section 11 of the Internal Audit Act 2010.”
