ICO Decision On PATI Request To Cabinet Office
Information Commissioner Gitanjali Gutierrez issued Decision 09/2023 in regards to the Cabinet Office.
A spokesperson said, “On 21 June 2023, Information Commissioner Gitanjali Gutierrez issued Decision 09/2023, Cabinet Office. The Applicant had submitted a Public Access to Information [PATI] request to the Cabinet Office for its records on tech companies BPMS Ltd, Innofund Ltd, Innofund Innovation Incubator Ltd and the Fastpass port of entry system.
“The Information Commissioner found that the Cabinet Office did not issue an internal review decision to the Applicant within the 6-week timeline set out in the PATI Act. However, during the Information Commissioner’s independent review, the Cabinet Office issued an internal review decision for the PATI request. As a result, the Information Commissioner does not require the Cabinet Office to take any further action with respect to Decision 09/2023.
“This Decision does not address whether or not the Cabinet Office has properly denied access to the requested records. Rather, it addresses the basic obligation upon the Cabinet Office to respond to an internal review request within the statutory timeframe.”
