Information Commissioner LaKai Dill issued Decision 14/2025 regarding the Bermuda Police Service.

A spokesperson said, “On 8 August 2025, the Deputy Information Commissioner LaKai Dill issued Decision 14/2025, Bermuda Police Service, which reviewed the BPS’s refusal to disclose records related to prior PATI requests that requested information related to the Applicant, including decision-making documents and records that had been disclosed to other requesters under PATI. The BPS’s internal review decision stated that certain records did not exist and that the disclosure of the responsive records contained personal information and were therefore exempt from disclosure.

“Under delegated authority, the Deputy Information Commissioner upheld the BPS’s decision in part, finding that disclosure of certain parts of the records would have identified prior PATI requesters and other individuals’ personal information and that their disclosure was not in the public interest.

“The Deputy Information Commissioner also reversed part of the BPS’s decision, finding: [1] that information relating to the Applicant alone was not exempt personal information, in the circumstances, and should have been disclosed to the Applicant; [2] that the disclosure of certain information would not have personally identified any individual; and [3] that the public interest fell in favour of disclosing the personal work information of the former Commissioner of Police and the then-Deputy Commissioner of Police. Finally, the Deputy Information Commissioner found that the BPS had met its obligations to search for responsive records and respond to the Applicant’s request.

“The Deputy Information Commissioner has ordered the BPS to grant the Applicant access to certain records in part (with exempt information redacted) on or before Friday, 19 September 2025.”
