Man Charged With Sex Crime Receives Bail

The 38-year-old Sandy’s man who was yesterday [Sept.12] charged with the sexual exploitation of two young girls, and who was remanded into custody overnight, reappeared this morning in Magistrates Court.

At the end of this morning’s continuation of his bail hearing, he was released on $10,000 bail with one like Surety.

As part of his bail conditions, he was ordered to not interfere with and to stay away from any victims or witnesses; and between 8:00am and 8:00pm on every Monday, he must report to the Hamilton Police Station.

His trial was set down for Thursday 15th December at 9:30am in Court #4.

      The Nationality of a judge does not matter, its the law and the case presented by the prosecution. Irrespective of the crime committed, there is a limit on the punishment. The Bermuda laws were written by your predecessors who faired punishing their own families too harsely, so blame them.

    It truly disgusts me just how weak the Bermuda justice system is towards pedophilia and rape. And the aversion to having a database on child pedophiles is disgusting too. These men can’t be rehabilitated, it’s been proven. What an odd justice system we have here.

      When all of the foreign national Judges have run Bermuda into the ground, they will leave and go to their safe countries where the laws and judiciary system has been upheld. Think I am joking? This job is too important to outsource to people who don’t give a damn about Bermuda.

        I agree send all foreigners home. Then when Sally and Peter commit a crime they go before the Judge who is their Uncle, Cousin, or Daddy. How is that for unbiased justice? Then Bermuda shall sink to a low high.

          Unlike you, I have confidence in my Bermudian people to do the right thing because my fate is theirs and vice versa. When they make the bed hard they have to lie in it too. People on these sites are clamouring for Justice, appropriate penalties, and they want to be able to rely on a system that says what it means and means what it says, nothing more. It should be that a defendant doesn’t want to see Uncle, Cousin or Daddy on the bench because they fear they’ll get a harsher penalty ‘because they know better’.

          Why can’t we turn things around? With the perpetrators committing crimes, in conjuction with soft/irresponsible penalties, conditional discharges, and jurors who fail to convict, a safe life as we know it in Bermuda is being undermined. Start lopping off the cancer at the top of the tree and work towards the root of the problem by encouraging our Bermudian law practioners to pursue these judiciary posts. Increase the salary ranges for these posts to make it attractive.

          Think about it – a judiciary system that sets the tone that offenders will be dealt with swiftly, efficiently and to the fullest extent of the law will act as a deterrent. The highly paid defence lawyers may find their coffers are not quite as full.

          It’s right that people should be appalled by this crime, but not let’s forget that for every child who might be subject to sexual abuse there may be 10x that who suffer serious neglect/abuse through drug and alcohol abuse or through inadequate parenting. Let’s get angry about government cuts to essential children and family services and try and do something about that instead of hate towards one man

    Hello people, just some inside information because in order to understand a decision like that you have to know the psyche of the so called “leaders”. Once you know how they operate things like this wouldn’t surprise you. I’m not going to go too deep though, research it for yourself. Like I was saying the so-called “leaders” e.g. Judges, Politicians, Police Officers, Teachers, Clergy and the list goes on are pedophiles themselves so they protect their own. We better wake up soon before they legalize these monstrosities!! I for one do believe in innocence before proven guilty but are you serious!! It’s the beginning of the end everyone, please wake up and find out what’s really going on in our world . There’s a war on for your mind!!

    I know that this person has not pleaded guilty nor has he been convicted of this offense but the public wish to feel safe. I hope those girls are going to be safe. I really hope he does not bother them.

    When you think about the conditions of bail, it is crazy because this gives the defendant a lot of time to skip the island. Reporting mondays only makes no sense to me. It should be at least 3 times a week and twice on those days. At least they would know where these crazy people are.

    I am sick and tired of these easy conditions.

    I heard Judge Judy say on the Larry King Live show one night that the only thing you can do to cure a paedophile is to take a gun and put a bullet in his brain.

    These lawyers and Judges need to get it together and quickly. You throw the book at a young person who steals a bike but give a sick monster paedophile breaks.
    A paedophile is one of the worst kind of crimes a human being can commit,,worse than a crack addict and a theif.
    These lawyers need to get it together .Read what that lawyer said on the RG website its a bit concerning for any bermudian with a child.

    Ok um a lil confused. How can a sex offender have the right 2 not b named 4 legal reasons. Wth so I take it us as the public with little children don’t have the right 2 know who these dirty pervs are. This system is all backwards. They give u time and blast ya name in the paper 4 a bag of weed but pervs go nameless… We need a place 2 put these ppl name and pics up so we as the public kno who these offenders are. Can u spell city hall. HALL OF PERVS. They should have their own wall and make the kids go on field trips just so they know who 2 avoid.       The sex offender is not the one being protected. They are not named to protect the victims. The only way to have the offender named is with the premission of the victim.

      A woman who was rape several years ago named her attacker after he was found guilty.

      What should happen in my opinion is that when they get out of jail aka West Gate Resort, they should be named as by then most people will not be able to tie the offender to the victim.

    In this culture, cildren, especially little black girls are valued least. What is most disturbing about the repeated excusing of violence against our kids is our collective refusal to do any and everything to protect them.

    Everyone who has been commenting needs to realise that every Bermudian has the RIGHT to bail. The reason why this is because of the old adage of English justice which says that a person is presumed innocent until proven guilty.

    Many have expressed concern about the victims. But just because someone makes an allegation, it shouldn’t be taken as gospel sight unseen. This chap has pleaded not guilty; he is contesting the charges. They could very well be complete rubbish. If he he were remanded in custody and were found not guilty at the end of trial, he will have spent a number of months locked up with serious criminals – he would be punished for no reason. It’s all besides the point to say “well, you’ve had your day in court and walked free” if he would have been away from his family during this time and lost his job.

    Bail can only be withheld if the judge has substantial grounds that the defendant will either (1) fail to surrender, (2) commit further offences whilst on bail, or (3) interfere with witnesses or otherwise pervert the course of justice. And before bail can be withheld, the judge has to be sure that certain conditions cannot be imposed to alleviate those concerns.

    Many of the people who get remanded into custody will often have a record of offending on bail or trying to escape from justice that a judge will say ‘piss off, you’re going inside’. But this chap could very well have never had any trouble with the law before. And here, the surety and weekly reporting addresses failure to surrender, since he’ll lose a healthy chunk of cash. The non-contact conditions deal interfering with witnesses.

    Many people really have no idea what goes on in the criminal justice system and they should really exercise caution before they shoot from the mouth.

    Also, the reason this man’s ID is hidden has nothing to do with protecting him. It’s all about ensuring that the young people who are the alleged victims cannot be identified. It’s for THEIR protection.
