Legal Action After Bermuda Emergency Landing

A number of the 300-plus passengers aboard a British charter flight which had to divert to Bermuda last month after a small fire broke out in its cabin are taking legal action against UK vacation company Thomas Cook.

Sheffield’s “Star” newspaper reports today that Doncaster couple Danny and Liselle McEwan are among the passengers seeking legal advice.

They plan to sue the holiday company, claiming the incident left Mrs. McEwan with carbon monoxide poisoning.

“It was an absolutely terrifying experience,” she told the newspaper. “About 40 minutes after take-off the seat TVs started crackling and there was a strange smell … I was terrified the aircraft was going to burst into flames and plunge into the Atlantic.

“It was obvious there were many other passengers who were also terrified and suffering from inhaling the smoke. Although the smoke kept coming out for a while there were no oxygen masks, and after we were evacuated I almost collapsed and had to be treated by paramedics.”

The couple, who had been celebrating their fifth wedding anniversary, were later told there had been an electrical fire in the in-flight entertainment system.

UK law firm Irwin Mitchell is now taking action on behalf of some passengers of the May 1 Airbus A330 flight.

    Let me understand this, there was a tech problem on the plane, it diverted here to avoid problems, it landed safely, no one got hurt or died and they want to take legal action………and if the pilot had ignored it and the plane caught fire and fell out of the sky what would they have done then, why not give them the £150 back for their cheap holiday!

      Why I never travel with Thomas Cook. They have so much claims against them in the past 5 years, between thier cruises and flights I just can’t see why they don’t go out f business. There policy is, If something happens, and you did not buy travel insurance, then forget it. They are not liable for nothing.

    If you were not on the plane, you do not know the real circumstances. The law suit may or may not be valid. Only those people involved know what happened.

    Hold on hold on, let me get this straight, the couple is going to sue the airlines because they claim they got carbon monoxide poisioning, but the airlines and her statement both lead to the same conclusion, that it was an electrical fire. Now unless the electrical wiring was coated in gasoline, how did she got carbon monoxide poisioning?

    This is the last you will hear of this. They are ‘trying it on’. It will be settled out of court. It is very sad that the world is now full of compensation chasers that drive up everyone’s insurance premiums, but alas that is the world we live in.

    Well I dont know about the carbon monoxide poisioning BUT oxygen mask should deploy in any emergency that is mandatory for aircrafts. Usually on flights they give a tutorial in the beginning on how to use them and when they deploy I’m pretty sure a fire would be a good enough excuse to use an oxygen mask dont you think?

    From my knowledge an oxygen enriched environment will greatly increase the ability of anything flammable to ignite even with the smallest spark… May be a good thing that no oxygen masks deployed if there was a fire on the plane? Could be wrong…

    Just for your information, the oxygen masks only provide oxygen for a few minutes (or just enough time for the pilot to descend to a lower altitude to where air can be pumped into the aircraft). The passengers cant be sucking on the masks for as long as it too to get to Bermuda.
