36-Year-Old Man Sentenced To Three Months
A 36 year old man – who was said to be suffering from a rare psychiatric disorder that causes hyper sexuality — was this morning [Sept 23] sentenced to three months in prison.
However, because he has been on remand since 29th July and time spent in custody will count, he will shortly be released.
At his initial appearance in Magistrates Court in July, Kevin Rubaine had pleaded guilty to sexual assault, in the form of repeatedly touching a 17 year old female on her thigh while they were on a bus earlier that month.
In a victim impact statement read out in Court, the teenager wrote that she now felt awkward and scared, and had bad dreams. She recounted that she worried about being on the bus at night and that her parents were now more concerned about her.
Senior Magistrate Archie Warner was told by Rubaine’s defence lawyer that the Psychiatric Report prepared on Rubaine said that he suffered from Kluver-Bucy Syndrome.
He said that the Report indicated that this was a rare disease that affected 1 or 2 persons out of every one million; and that one of its characterizations was hyper sexuality.
Before handing down his sentence, the Senior Magistrate said: “This case is different. There is a high risk of re-offending, therefore protection of the community becomes paramount. But this society recognizes that you cannot put a person in a dungeon and throw away the key.”
The Magistrate continued: “All we have is a prison. We need a Mental Health Court and a facility for people who have long term mental health problems, who are a threat to the community, and who need support and facilities. It is not good to try and lock away people without providing support and help.”
The sentence is to be followed by two years on probation during which time Rubaine will be put into programs designed to help him.

If Bermuda is not prepared to deal with these types of people they should be sent to the UK for Special Treatment.
Law Abiding Citizens MUST be protected whatever the cost.
And why exactly should the UK take the burden of this? Can they send their mentally unwell patients here for some rest in the sunshine?! Somehow I doubt it.

I wrote a complaint about the increase of criminal cases amongst the mentally ill in Bermuda to the Health Counsel about a year ago. I questioned wheter there is the right rehabilitation at M.A.W.I and the response I got is that Bermuda is not up to date with Psychiatric therapy. There isn’t even rehabilitation at M.A.W.I!!! I think there should be some serious revamping at that so called wellness center.
So true. Bermuda is incredibly behind in its rehabilitation services. Don’t get me wrong, there are a number of wonderful therapists and psychiatrists on the island who provide great care – if you can afford it.
Good for Senior Magistrate Warner on his recognition of the lack of proper care for mentally ill offenders. Locking someone away in a prison cell without proper care will only result in the same person, with the same, if not exacerbated, condition, being released into society at a later date.
We dont need a mental health facility, we have waters that surround us. 2 cement boots 20 miles away should rehabilitate him and everyone at west gate. Open every cell for a swimming field trip

The Senior Magistrate stated that there is a high probably that this individual will re-offend therefore his mug shot should be posted on a sexual predators website administered by the Ministry of Public Safety. These individuals should also be required to wear electronic monitoring devices and their locations updated on the “sex pests” website. These measures will, at least, allow the community to keep an eye on these individuals more closely, with the expressed purpose of protecting the children.
Bermuda has to accept the fact that there are more mentally ill people today than what we had in the past. People have all kinds of mental issues not seen in Bermuda before and we need a facility to address this, not going and beating up the mentally ill or exposing them as criminals for something they cant control and cant get help for. Although the public should be aware of those who walk among us for our children’s safety.
