Protectors & Power-Holders In Trusts Symposium
Appleby participated in the recent “Protectors and Power-Holders in Trusts” Symposium, a unique gathering of talent from across the trust law world featuring speakers from leading global firms.
Appleby lawyers Keith Robinson, Gavin Ferguson and Fraser Robertson served as panellists, and shared their litigation and advisory work expertise concerning protectors in offshore trusts at the conference, held 26 February at the Grange Tower Bridge Hotel in London.
Mr. Robinson, a partner in the dispute resolution department of Appleby’s Bermuda office, participated in a panel session titled “Back-Seat Drivers: The Risks and Rewards of Settlor Reserved Powers,” which addressed the effectiveness of reserved powers legislation.
Mr. Ferguson, managing partner of Appleby’s Guernsey office, and Mr. Robertson, a partner in the Jersey office, served as panellists in a session titled “Protectors in the Firing Line: Potential Claims Against the Protector,” which included strategies for minimising protectors’ exposure.
Mr. Robinson, whose practice focuses on high value trust disputes and restructurings often with a multi-jurisdictional element, commented, “This was perhaps the first global conference on the ever more important role of the trust protector, a critical player in the world of offshore trusts. Appleby in Bermuda and across its key jurisdictions has extensive expertise in acting for protectors, trustees and beneficiaries on protector-related issues.”
Hosted by financial conference organiser IBC, the event aimed to ensure attendees are up to date on all the issues of trust law and aware of all the potential pitfalls involved in being, advising or interacting with protectors and other power-holders, helping to safeguard both trust professionals and their clients against professional liability.
