BII Offer Seminar On ‘Bad Faith Exposures’

The Bermuda Insurance Institute [BII] is offering a session for insurance professionals designed to address issues with regards to bad faith exposures under follow-form liability policies.

Topics to be addressed include jurisdiction of US courts, standards of conduct, bad faith and the duty to defend, interaction between excess carriers, and pursuing coverage defenses without creating bad faith exposure, and an overview of catastrophic bad faith judgments.

Entitled ‘Bad Faith in the USA’ the seminar will be presented by Michael Foran, a Partner at Foran Glennan, a law firm specializing in legal representation and consultation to businesses, insurance companies, healthcare, and governmental organizations.

Mr. Foran said about the seminar: “Bad faith claims, a staple of policyholder litigation strategies in the U.S., can turn into a nightmare for companies and claims professionals.

“The presentation examines how claims professionals can avoid or best insulate themselves and their companies against such claims. We also review how bad faith standards affect the way claims professionals and carriers treat each other and what happens when bad relations become bad faith.”

Michael L. Foran concentrates his practice in first-party property insurance disputes. His experience includes the full array of first-party property insurance matters, including bad faith claims, environmental damage, builder’s risk claims, construction and design defect claims, arson and fraud issues, and cargo losses.

His experience also extends to reinsurance disputes, particularly those dealing with first-party property claims, as well as subrogation and casualty defense.

Mr. Foran’s practice encompasses all phases of the claims and litigation process: consultation during the claims handling and investigation phase; mediation, arbitration, and other forms of alternative dispute resolution; litigation; and trial.

He has also helped insurers develop benchmark policy forms for oil, gas, and petrochemical industry exposures; policy coverages for mortgage-backed securities; and specialized endorsements for commercial and personal lines policy forms.
