Decision On Hospital Response To PATI Request
Information Commissioner Gitanjali Gutierrez has issued her latest decision, this one related to searches for records held by the Bermuda Hospitals Board following a PATI request.
The ICO office said, “This decision concerns the reasonableness of a search conducted by the Bermuda Hospitals Board in response to a PATI request related to the number and details of safety events at the King Edward VII Memorial Hospital between 2011 and 2015.
“The requester challenged the reasonableness of the search conducted by the Bermuda Hospitals Board. During the Review, the parties agreed to engage in a facilitated resolution.
“As part of this process, the Bermuda Hospitals Board improved its searches to locate records responsive to the request, and subsequently provided the requester with partial access to the additional records.
“The Information Commissioner has found that the Bermuda Hospitals Board’s initial search did not meet the reasonable search requirements under section 12[2][b] of the PATI Act and regulation 5 of the PATI Regulations.
“The Information Commissioner, however, is satisfied that the Bermuda Hospitals Board’s additional search was reasonable. The Information Commissioner has expressed appreciation to the Board for its efforts during this review.”
