Four ICO Decisions On Ministry Of Justice HQ
Information Commissioner Gitanjali Gutierrez issued four decisions concerning the Ministry of Justice Headquarters.
A spokesperson said, “On 23 September 2024, Information Commissioner Gitanjali Gutierrez issued Decisions 26/2024, 27/2024, 28/2024 and 29/2024, which considered the Ministry of Justice Headquarters’ failure to issue internal review decisions on four PATI requests seeking legal aid records.
“Information Commissioner Gutierrez found that the Ministry Headquarters did not issue internal review decisions to the Applicant within the 6-week timeline set out in the PATI Act. The Commissioner has ordered the Ministry Headquarters to issue the Applicant its internal review decisions by 21 October 2024.
“In ‘failure to decide’ cases, the Information Commissioner does not address the underlying records responsive to a PATI request. Instead, it is a decision on whether a public authority has responded to a request within the statutory timeframe. Once an internal review decision has been issued, if a PATI requester is not satisfied with the public authority’s response, they may seek an independent review by the Information Commissioner of that substantive decision. It is at that stage that the Information Commissioner will consider whether a public authority, such as the Ministry of Justice Headquarters, has properly denied access to any of the requested records.”
