ICO Decision On Department Of Planning
The Information Commissioner issued Decision 02/2026 regarding the Department of Planning.
A spokesperson said, “On 3 March 2026, Information Commissioner’s Decision 02/2026, Department of Planning, was issued. This Decision, made by the ICO’s Acting Senior Investigation Officer, was issued under delegated authority from the Information Commissioner. The Acting Senior Investigation Officer found that the Department failed to comply with the requirements for an internal review, with respect to a request for records held by the Department about a parcel of land, within the six-week timeframe set out in the Public Access to Information Act 2010. Since the Department issued an internal review decision to the Applicant during the Commissioner’s review, no further action was required.
“In ‘failure to decide’ reviews, such as this, the Information Commissioner’s Decision does not address access to the records being requested. Rather, it focuses purely on whether a public authority has met its statutory obligations for an internal review within the statutory timeframe. Decisions and orders in failure to decide reviews allow the public authority the opportunity to make one final decision on granting or refusing access to public records it holds—by way of an internal review by the head of the public authority.
“Once a public authority’s internal review decision has been issued, if a PATI requester is not satisfied with the public authority’s response, they can seek an external review by the Information Commissioner. It is at that stage that the Commissioner will consider whether a public authority has properly decided that refusing access to public records is justified according to the PATI Act.”
