Attention: Mr. Mark Fields, Chairman of the Board of Commissioners
Re: Extension of Direction to the Regulatory Authority on the Retail Fuels Price Cap
Whereas the Regulatory Authority Act 2011 [the “RAA”] empowers the Minister under section 7 to issue general policy directions to the Regulatory Authority [the “Authority”];
And Whereas the Fuels Act 2022 [the “FA”] empowers the Minister under section 7 to issue general policy directions to the Authority on matters of general policy concerning the fuels sector;
And Whereas the Minister has consulted the Authority in accordance with section 7[1] of the FA in respect of this Direction;
And Whereas the Minister considers that it remains in the public interest to maintain the existing retail fuel price standstill for a further period of six [6] months, subject to the adjustment mechanism set out in this Direction;
Now Therefore, the Minister of Home Affairs, in exercise of the powers conferred by section 7 of the RAA and section 7 of the FA and all other enabling powers, hereby issues the following Direction:
Direction
1. Citation and Extension
[1] This Direction may be cited as the Retail Fuels [Consumer Protection Standstill] [Extension] Ministerial Direction 2026.
[2] The Retail Fuels [Consumer Protection Standstill] Ministerial Direction 2026, dated 14 April 2026, is hereby extended for a further period of six [6] months.
[3] The extension shall take effect immediately upon the expiry of the existing Direction and shall remain in force for six [6] months, unless earlier revoked or superseded by a final general determination of the Authority.
2. Continuation of Retail Fuel Price Standstill
[1] During the extended period, the policy standstill established by the existing Direction shall continue in full force and effect.
[2] Downward adjustments to retail fuel prices shall continue to be permitted.
3. Adjustment Where Customs-Duty Relief is Insufficient
[1] Where an increase in the underlying cost of a regulated fuel would result in an amount required to maintain the applicable Standstill Ceiling that exceeds the total customs duty applicable to that fuel, the applicable Standstill Ceiling may be increased by the amount of the increase that exceeds the total customs duty available to offset the increase.
[2] Any adjustment under paragraph [1] shall be limited to the amount necessary to account for the portion of the increase in the underlying cost of the fuel that cannot be offset through the available customs-duty relief.
[3] The Authority shall determine and publish any adjustment to the applicable Standstill Ceiling in accordance with this clause.
4. Customs-Duty Relief
[1] The customs-duty relief arrangements established under the existing Direction shall continue during the extended period.
[2] The customs-duty relief shall be applied to offset increases in the underlying cost of regulated fuels to the extent of the customs duty available for that purpose.
[3] The Authority and the Ministry of Finance shall continue to administer the customs-duty relief arrangements in accordance with the applicable arrangements established under the existing Direction.
5. Continuation of Existing Arrangements
Except as expressly modified by this Direction, all other provisions of the Retail Fuels [Consumer Protection Standstill] Ministerial Direction 2026shall continue to apply during the extended period.
6. Interpretation
This Direction shall be read together with the Retail Fuels [Consumer Protection Standstill] Ministerial Direction 2026.
Sincerely,
The Hon. Alexa Lightbourne, JP, MP
Minister of Home Affairs
