Accounting Intern Has Weed Charge Dropped

In Magistrates Court this morning [Mar.29], a 23-year-old who said that he was an intern at one of the major accounting firms on the island had the charge of being in possession of illegal drugs withdrawn.

The young man was appearing before Magistrate Archie Warner, had already entered a plea of guilty to the charge, and had offered his explanations for his behavior.

Speaking almost inaudibly, he said that he was very sorry, remorseful, and that this was the first time that he had appeared in a Court. He said that he was intern in the accounting profession and was intending to go abroad to further his studies.

Having considered the charge, the amount of cannabis consisting of 2.3grams in one hand-rolled cigarette, and having heard his explanation; Magistrate Warner commented to Robert Welling, the duty Prosecutor from the DPP’s office, that he thought that there was a policy in place, instituted by the DPP’s office, that in some circumstances possession of small amounts of cannabis could be handled by means of a Police caution. Mr Welling agreed that he was aware that such a policy might exist, was not closely familiar with it, and promised to explore it.

Magistrate Warner then delayed his judgment pending the arrival of the information that Mr Welling needed. On production of the sought after information, the charge against the young intern was dropped and the matter was sent back to the Police so that it could be handled differently.

    there are a lot of young people whose ‘promise’ has been destroyed by our drug laws. what makes this fella different? oh, well at least it’s a change in the right direction. Minor possession shouldn’t even make it to the courts.

    It seems that the Magistrate did the right thing. To continue to crimalize a large segment of Bermuda’s population for what in most other civilised areas is a misdeamour or ignored shows Bermuda is living in the 19th Century. Decrimalize possession of small amounts and make it retroactive so any one with a minor possession charge can buy it out – say $2,000. Government gets revenue and people get their lives back. Heck, people are charged for being accessories to murder but are let off on a technicality in Supreme Court. Magistrates Court is far worse. Insane.

      The problem with decriminalizing is that it only solves that particular issue. Do you know 4,000 children die every year from diarrhea? Over 10,000 people die per year from overdosing on Asprin. And I wont even go into the figures of cigarettes, but it is more than the top three killers combined. All these things, of course, are legal.

      0 people are killed per year directly by marijuana.

      Now, the issue is: why are we letting one of the safest substances in the world be the cash crop to fuel the people that are murdering our people?

      People of all colors are getting conditional discharges all the time you just don’t always get to read about them. It has nothing to do with color if you can pay a lawyer and can prove though character references, job, continued education, and possibly show a good community service most are ok. Chances are if you don’t do any of the above and or do not have a lawyer you will get balled simple equation really. Age has a part to as the older you are the better you should understand the law and its implication. If color is a factor how come prison sentences for murder, conspiracy for murder, assault and numerous other changes like escape from custody don’t get any real time? Just a thought as long as you and others believe others are more privliged they will be. This may not apply to politically connected people and prominant rich people but to be honest I personally have not heard of to many of them getting into trouble. The ones that do yes it is front page stuff and usually not a simple matter a small amount of weed.

      You know obviously you can look at this as the guy getting special treatment. On the other hand look at it as the judge (court) realized in this matter that the draconian drug laws we have were going to seriously mess up a young persons life. He’s doing good by all accounts and it aspiring to further his education the stoplist would have restricted him. Look at this as a win for the people of Bermuda. The courts realize that these laws are stunting our people’s growth and movement and while they can’t just change them by snapping fingers they found a way to try and work around them.

        Agreed as it is 2011 judges realise the real impact on the lives of youth who lets face it are the future of Bermuda and we need all the eductaed people we can get.     They tried to make alcohol illegal in the early 1900s, and it became very expensive like drugs in that time period… and so many gangs and murders came about due to alcohol then in those few years.

    Just because it is illegal does not mean its evil or bad for you. It just means some retards wearing wigs, with big egos, sat in chairs and decided what everyone else should be subject to.

    Please call for a study of how the Criminal Bench sentences similar offences in Bermuda. I always heard that Barbadian Judges were harshest against black criminals, let’s get some empirical evidence and dispel or prove this once and for all.

    I wont comment on how serious the matter is or isn’t. But what annoys me is that the elders of our community act like they have no skeletons in their closet. Just becaue you (generally speaking) didn’t get caught doesn’t mean you are better than the next person or lessen the offense. We all deserve 2nd chances, and if you want to go Biblically speaking, how many times does God say to forgive your neighbor? Yes there will be hurdles to jump, obstacles to overcome, and the desperate need of another chance after falling, but no one person is perfect. Why sever the future of a potentially successful person. There are heinous crimes being committed, and I know some are thinking, “let’s nip it in the bud,” but would you rather give a chance and see a flower bloom, or give a record and inevitably destroy confidence and create another “gangster?” This is coming from a 26 year old who was given another chance by the courts, and is now studying counselling.

    The point here should be that a sort of precedent has been set. It has been available for many years. Police have always had the option of a warning for small amounts and just possession. Depending on the persons anteceedants and/or criminal history, if any.

    Plus, it’s all the UBP’s fault.

    On the matter of colour of skin, inequality etc – all parties involved are black.

    On the matter of naming people, its not unheard of for us not to name people, this same day alone the last three people reported on in Court a few hours before this were not named. Numerous stories are carried without full names, always have been, this is nothing new.

    Reasons range from being the person being charged for some form of sexual assault, being a minor, bans from publication by the Court, appearing but not actually being charged, protecting the identity of a witness assisting the prosecution in gang related trials and various other legal and policy grey areas.

    On the matter of him being let off, its not unheard of for the Court to discharge smaller matters, couple more recent examples we covered below:

    However – this was the first time we heard of the policy change spoken about in Court allowing small possession to be handled via a Police caution rather then court.

    That is something we personally had not been officially notified of, nor heard in Court before [may have been said while we weren't there however]. We will see in the coming months how it progresses.

      Actually if you call the police and ask hypothetical of course they will tell you the same as it is up to the arresting officer to charge you. Also again as age is a factor in this as young people have their whole life in front of them. I have see charges dropped in court and out if court to both black and white. What you are seen to be doing with your life is probably the biggest factor higher education moves to be a successful person that could contribute to society in the future are also factors. If you sit on a wall or are seen as a drop out or not about being self progessive then your battles get harder.

      This is the loop hole that feeds the conspiracy it’s up to the judges discretion but due to the size of the fine it sounds like he was near a school or increased penalty zone as the fine is usually weight * perceived value or some such thing or he might have had a previous record.     Convict someone for something that is common in society and head them down a road where opportunity is limited to gain a law abiding and productive life. Convicting our young people with criminal records for a substance that does less damage than any other we abuse and we will continiue to have alienated young men who seek a life of crime. They have been pushed down that road by the law itself. It is so plain to see. If I get drunk and head down the road in my car and am caught, do I get put on a stop list? In reality I am more of a danger to society when I am drunk than a man who has yet to smoke a spliff in his pocket.

        The court did the right thing. It is the draconian laws of Bermuda though that have already done the damage in years past. Use of Marijuana is prevalent in Bermuda, it is scientifically now proved that the previously fabricated ill effects of smoking it do not exist. Like pro-habitation of Alcohol in the United States, it’s illegality and harsh penalties continue to make it an expensive substance with huge profit potential. When un-regulated, anything that makes money will fall into the hands of organized crime and young men when convicted on minor drugs charges will be forced into a criminal society. It is the law that makes them criminals, not their action of smoking weed.

    As I read some of the comments here it is clear that many of us are very ignorant about about a lot of things but still feel comfortable about making statements based on something which they “heard”. When I was in college, one of my professors told the class that if alcohol were discovered today it would be an illegal drug. I am in my early 60′s and without exception, every one of my friends who have consumed alcohol on a daily basis for the past 30 years or more have serious medical issues – those that are still alive!

    Maybe it’s co-incidence, but the ones I know that smoke a few times a week and drink only occassionally have no medical issues. If I were in charge I would make alcohol illegal and marijuana legal.

    You’d be surprised at the Bermuda Government leaders over the past several years who while being on official Gov’t business overseas, have been an embarassment to Bermuda while getting “stupid drunk” from alcohol.)

    Because it is legal does not mean it is OK (and vice versa). Remember slavery was once legal too!

    I think the more disturbing trend is that some of the people commenting here are assuming that because the kid is an accounting intern, is going somewhere and doing something with his life that he must be a white boy. Thats the only crazy thing about this whole page. Why is it hard for people to picture a young black man fitting this role? Maybe the change Bermuda needs and is looking for isn’t going to come from changing laws. Maybe we need to look at what we think we and others are capable of, and not some outdated stereotype.

    Here it is my son as an aspiring musician when he got caught with 0.08 grams of Cannibis his name went on the stop list,he has since which applied for numerous waivers and gets denied every time because of this offence ( 0.08 grams of weed )which is also hindering him from travelling to U.S and Canada and here this guy is caught red handed with a Bob Marley cone in a increased penalty zone and gets off ?
