21-Year-Old Man Jailed For Multiple Offences

Senior Magistrate Archie Warner this morning [July 26] sentenced Troy Harris, 21, to eighteen months in prison after he pleaded guilty to multiple offences committed in May 2012.

On 15th May Harris was found in a dwelling house when he had no lawful excuse for being there; and for breaking a window in the process of entering the dwelling.

The next day, 16th May, he unlawfully assaulted a young woman by punching her in the face and when he was arrested he escaped from Police custody by running away.

On 17th May, Harris had taken a motorcycle without the owner’s permission and collided with a car which resulted in police being called and him being charged with driving/riding without due care.

Harris first appeared in Magistrate’s Court on 29th May. At that time he was remanded into custody to await sentencing and submit to a Social Inquiry Report [SIR].

From the prisoner’s enclosure, Harris told the Magistrate: “I apologize. I got myself in trouble.” Speaking in mitigation, Duty Counsel Leopold Mills said that Harris, who was on probation, had not availed himself of the facilities of Court Services.

This prompted a response from the Magistrate who said: “Over and over…” The Prosecutor pointed out that the SIR indicated that Harris was not suitable for a sentence of community service.

Having considered Harris’s previous criminal record and the updated SIR; the Senior Magistrate sentenced Harris to prison terms of 18 months for entering the dwelling house; 12 months for punching the young woman; 3 months for damaging the window; and 3 months for escaping Police custody.

The Magistrate ruled that all sentence were concurrent with each other, which means that Harris’s actual sentence is 18 months.

Harris then faced four traffic charges stemming from a Police stop in May. These were, having no driver’s license, failing to stop at a stop sign, disobeying a traffic sign, and driving in a dangerous manner.

Harris pleaded guilty to all four and was fined a total of $1,000 with 100 days to be served if the fines were not paid. Harris also plead guilty to a charge of driving without due care on 17th May and was fined $250 with 25 days to be served in default.

Telling the Magistrate that couldn’t pay and asking if he could “do the time”, the Magistrate obliged and told Harris that he could, and ruled that the total default time was to be concurrent with the other sentences.

As Prison Officers escorted Harris towards the grey door leading to the cells, Harris turned, smiled at the Magistrate, and said: “Have a good day, right, Mr Warner?”

    I’m sick of these judges giving these fools multiple sentences for multiple charges only to have them run concurrently. Say a guy rapes and kills a young girl. He only serves time for the murder essentially because the rape is less of a crime in the eye of the law and always has a shorter sentence. Great logic there judicial system

        Not vindictive. Just pissed off with inept judges who don’t give adequate setences. You commit 30 crimes, you get the same sentence as the guy next to you who committed one crime. It’s absolutely frikkin stupid.

      Totally agree with you. He’s crying out for attention. Once his granny passed away that was it for him. Very unfortunate situation.

    Good ole Troy jr. Troy Sr was in court the day before for punching his girlfriend while drunk and now son in court and both remanded in custody. Some crap.
    This young man needs help as i do know him and he’s been unlawfully entering homes for awhile now. Finally caught up with him.

    There was no need for the magistrate to make these offences concurrent but he did anyway. This is part of the problem we have in Bermuda, people do not fear going to jail!
