Man Denies Parked Cars Prevent Public Access

Mark Sousa who is connected to the Cardoza’s garage on Mission Road in Paget, this morning [Nov 6] pleaded not guilty in Magistrates Court to being a common nuisance by unlawfully preventing public access to a public road between 1st May 2013 and 30th September 2013.

The allegation is that vehicles that have been brought or taken to the garage and body shop on Mission road are left parked in no parking zones and that at times, normal access has been blocked.

Mr Sousa is represented by lawyer Chen Foley and Senior Magistrate Archie Warner set trial for January 2014 and granted Mr Sousa bail of $1,000.

              It is sad to even have a car garage in a residential area.There is one in Lime House Lane Baileys Bay which give the neighbors grief.I have been there a few times last year and what a mess.Planning
              dept. please get to work those neighbors own their nice homes but the garage is devalueing their properties.

      Let me tell you something the fire truck comes through occasionally and it fits perfectly fine! It has come to houses up here many times and our neighborhood is not that big to were they couldn’t take the other road if they felt the need to< HUGE trucks fit through that road with cars parked there, FOR YEARS…. now all i have to say is that if you do NOT live on this road then don't voice your words because you have no evidence or long turn proof to even prove your opinions. So STOP! the garage has been here since 1946 and as long as my family has lived here the garage has not been a problem.. It's the new people that have moved around here that have a problem.. but that is funny you moved next to a garage but you want to complain when they do there work? If anyone else has a problem and you dont live around this neighborhood your opinion has no grounds and it does not matter. Your all a bunch of rude people with so much hatred! GROW UP!!

So do you think it’s right for an operator of a garage to park cars on an road 24 hours a day, 7 days a week, 365 days a year and totally disregard whomever lives in the area simply because as you say why purchase a home next to a garage. Hmmmmm I cannot help but wonder if you are Mr. Sousa himself or a close friend because that simply makes no sense whatsoever. Let’s look at this for what it is assuming that you are not Mr. Sousa and more than likely your the friend. Well I must point out that you are not a true friend.

              Actually the road was taken in 1963 by an order in council. Govt never gazetted the take over. And never paid any one for it. So. It was taken. Never told any body and never paid for it. So since there is no head deed and govt cannot produce one. Cardoza’s claims absolute possession for the land which borders it property. So yes Cardoza’s does own the road. That is what the court case is about. Who owns the road!

    Let me tell all of you something…the garage has been there since 1946 probably been around longer then your parents have been alive…everyone is out here worrying about the garage and how cars shouldn’t be parked on one side of the road…your acting like the road is completely blocked and no big trucks or any vehicle can get through… this is NOT the case! Any emergency personnel can get through even a trash truck so i don’t want to hear it! Everyone is worrying about the garage, what about the violence in Bermuda, the gangs and all the corrupt people we have around and people are seriously worrying about a garage.. leave the guy alone! his trying to make a living just like everyone else, put yourself in his shoes! and all of you stop being inmature adults!

    Simply have the police come ticket the car(s) that are on the roadside. When the owners of said car(s) come and find out that their cars have tickets that THEY THEMSELVES have to pay because the shop is surely not going to, see if that changes @balance mind when there’s less customers coming it.
