Court: Man Admits Being Drunk, Resisting Arrest

Appearing in Magistrates Court this morning [April 21], a 42-year-old man pleaded guilty to being drunk and incapable and violently resisting arrest, with the Court hearing he was seen washing his face with beer.

Omar Young pleaded guilty to being drunk and incapable and violently resisting arrest at Maximart on 4th April 2016.

The Crown Prosecutor told the Magistrate that a customer informed shop staff that a drunk man was in their car parking area.

Staff checked and observed Young who was, at that time, apparently washing his face with beer.

Shop staff called police, and just before police arrived, shop staff saw Young rolling around on the ground fighting with another man.

Police arrived, found Young looking as if he was intoxicated, noted that he smelled of alcohol, and his speech was slurred.

Police attempted an arrest but Young resisted saying: “You’re not taking me in.” He grappled with the police, and he and the police officer fell to the ground.

Police then used Captor spray, but this did not subdue Young. Police then employed a Taser and Young was then handcuffed and put in a police vehicle.

Magistrate Khamisi Tokunbo initially fined Young $300 for being drunk and incapable and $500 for violently resisting arrest, however Young told the Magistrate that he could not pay the $800 fine as he was not working.

Duty Counsel suggested a period of Community Service. The Magistrate then ordered SIR and BARC reports and set re-sentencing for 10th June 2016.
