CAST Calls For Legal Reforms & Advisory Panel

Following the verdict in the Sophia Cannonier and Michael Watson case, Eugene Dean of the Collective Action Solidarity Trust [CAST] noted that “CAST advocates for comprehensive legislative reforms that balance public health concerns with individual rights” and ”for the establishment of an independent advisory panel comprising experts in epidemiology, public health, and legal affairs to guide decision-making processes.”

Eugene Dean said, “This verdict does not diminish the fact that throughout this process we, the CAST, have demonstrated our commitment to advocating for practices deemed to be in the best interest of public health—especially because the emergency circumstances were so exceptional.

“Now that we have a verdict, the question that continues to arise is why did it take so long?

“No one disputes that this global pandemic was unprecedented. There was widespread panic, our world was shut down, and emergency powers were activated.

“Due to these emergency protocols, rules and regulations, people were forced to cooperate with new health measures that could potentially be more harmful than beneficial, despite their reservations and genuine concerns about protecting the sanctity of their bodies.

“After researching the global COVID pandemic, CAST members agree that outdated regulations needed to be updated throughout the emergency, and that any new recommendations and proposals being debated globally must be given the appropriate consideration to restore confidence and bring about positive change.

“We have taken note that legal professionals around the world anticipate that the complete repercussions of COVID-19 may be felt in the courts over the next few years, potentially resulting in the filing of tens of thousands of pandemic-related cases. It is also possible that certain convictions from the past pandemic could be overturned because of new science and legislative amendments that come from this litigation.

“The frequency and drivers of change within this environment are shaped by a complex interplay of societal needs, political agendas, economic conditions, technological advancement, judicial interpretations, and treaty obligations.

“This acknowledgement underscores the complexity and challenges faced by Bermuda’s authorities during these uncertain times. However, it also highlights the necessity for a reassessment of our legislative framework to ensure that it aligns with the principles of natural justice and is supported by active citizenship.

  • “Scientific Evidence: The CAST calls for the establishment of an independent advisory panel comprising experts in epidemiology, public health, and legal affairs to guide decision-making processes. Policies must be grounded in rigorous scientific evidence to maintain public trust and efficacy.
