Court Reduces Charge to ‘Attempted Theft’

court gavel justiceThis morning [Jan 10] in Magistrates Court, before Chief Magistrate Archie Warner, Mr Devon Foggo, aged 39, was charged with the 5th February 2010 theft of a Vivitar camera valued at $195 from M&M on Church Street.

Mr Foggo initially pleaded guilty as charged but pointed out that though he had taken the camera from the shop display and concealed it inside his jacket; he had then been accosted by an M&M employee, had exchanged words with that employee, and had put the camera back. Mr Foggo said: “I gave the gentleman back his camera.”

On hearing this defence, the Magistrate questioned the information that had been presented by the DPP’s Prosecutor. The Prosecutor then quickly reviewed the Police evidence, agreed that there could be some discrepancies in the Police information and asked for the Magistrates permission to amend the charge. The Magistrate agreed and the charge was amended to ‘attempted theft’.

Explaining why he had missed his 21st December 2010 scheduled Court appearance to answer the charge, the accused who was brought to Court in Police custody, said that he had had the ‘flu’ and was unable to attend then.

In sustaining his guilty plea to the reduced charge of attempted theft and addressing the Magistrate, Mr Foggo asked for leniency and mercy from the Court saying that he was now working and was trying to get his life together, saying that he was: “…trying to get over all my obstacles.”

The Magistrate ordered a Social Inquiry Report, a return to Court on 24 February 2011, and granted Mr Foggo bail of $2,000 with one like surety.

    This is the first “attempted theft” I have heard of in 40 years.

    Next we will have ‘attempted drunken driving’.
    The courts are so far behind and so much on thier plate…

    Joe Smith from Paget told Mr. Warner….’I stabbed him, took the knife out and gave it to the police officer, covered the wound and put the knife back in the cutlery slot. I thought he said ‘carve the butt’. I’m a butcher yooo know…….

      If you leave the store with the item. It’s theft. If he never even left the store, and without a big incident, gave the camera back, I think it should be attempted theft.
