Pedal Cyclist Has Impaired Charges Dropped
In Magistrates Court this morning [Apr 2] a 48-year-old man faced charges of driving a pedal cycle while impaired by alcohol, charges which were eventually withdrawn.
The charge that Devonshire resident Dion Burgess faced was that on March 20th 2014, in Devonshire parish, he drove a pedal cycle on Middle Road whilst his “ability to drive that vehicle was impaired by alcohol.”
The second charge, which had the same date and location, was that he drove a pedal cycle having “consumed alcohol in such a quantity that the proportion of it in your blood exceeded the prescribed limit.”
Having read out the first charge, Senior Magistrate Archie Warner questioned Prosecutor Loxly Ricketts about the validity of the charge as read. Both the Magistrate and the Prosecutor then compared their Statute books and after several minutes of discussion a decision was reached.
With the agreement of the Prosecutor, the Senior Magistrate told Mr Burgess that the charge as put today was now withdrawn, but that the Crown had the right to bring the same charge or a fresh charge again within six months.

We pay police to parol ,arrest someone breaking the law ,and a magistrate ,a prosecuter,all those others involed in documentation and…and implementation right down the line….it amounts to a great deal of money …completely wasted at this point…the constituant ,the tax paying individual have a right to recieve value for money spent…..I personally feel an affront against my sensibilities….
Well looking at what he was charged with – “driving a pedal cycle while impaired by alcohol” and “drove a pedal cycle having “consumed alcohol in such a quantity that the proportion of it in your blood exceeded the prescribed limit”.” It appears he has been charged with the wrong thing – the last time I looked you don’t “drive” a pedal cycle by definition you pedal a pedal cycle – it’s all in the wording.
