June 16, 2015

Appearing in Magistrates Court this morning [June 16], an 18- year-old Bermudian who is studying at the New England Institute of Technology was given a twelve month Conditional Discharge after he pleaded guilty to using offensive words to Police outside an establishment on Dockyard on 13th June 2015.

The Crown Prosecutor told Senior Magistrate Juan Wolffe that when police arrived at a scene, the student was involved in a tussle, and when police intervened, the student told police: “You guys are just uneducated p—–s and you can f—k off.”

Later, at the police station, he said to police: “You f—-ts ain’t searching me.”

The Senior Magistrate ascertained that the student’s mother was in Court and asked her what kind of student he was and she told the Magistrate that he was getting 85% and 90% grades at the US college. She said that as a result of this incident, she was determined to: “…get him out of here as soon as possible.”

The Senior Magistrate spoke to the young man who then turned to face the public gallery and his mother and told his mother that he was sorry and ashamed that he had acted as he had.

The student explained his actions saying that he had been: “…very, very intoxicated..”

He admitted that he could not remember what happened at the Station, but admitted saying what he was accused of saying, He told the Senior Magistrate: “I’ve learned my lesson. I’ll never do that again.”

Saying that he considered that this was a “one off and a hard lesson”, the Senior Magistrate then granted a twelve month Conditional Discharge which means that if no further offences are committed within twelve months, no criminal conviction will be recorded.
