Man Cleared of Assaulting Officer

January 18, 2011

A Pembroke man was found guilty of possessing an offensive weapon and violently resisting arrest in Magistrates’ Court today [Jan. 18] — but Troy Smith was cleared of charges of assaulting two Police officers who attended a domestic dispute report at his home.

Mr. Smith, 29, was hospitalised with a broken nose and other injuries following the July 4, 2010 disturbance and claimed one officer used excessive force subduing him.

Police said Mr. Smith brandished a croquet mallet at them and threw a rock at one officer when they tried to take him into custody. The defendant had denied all charges at his December trial but admitted to using offensive words during the altercation.

Magistrate Khamisi Tokunbo ordered a social inquiry report and set sentencing for March, 11.
