45-Year-Old Man Charged With Sexual Assault
In Magistrates Court this morning [July 31] a 45-year-old man — who cannot be named for legal reasons — faced two charges of sexual assault.
Both charges alleged that between January 2011 and December 2011 he had touched two schoolgirls in a sexual manner.
The man pleaded not guilty to each charge and was granted bail of $5,000, required to provide a like surety, and was warned that until his December 2012 trial, he was not to have any contact with either of the two complainants.
Magistrate Tyrone Chin warned the man that this meant no contact by any means – phone, messaging, messages by third parties, or personal contact.
The Magistrate said that any breach might result in his being brought back before the Court and could result in his remand.

OK so these offences took place last year – it is now July 2012 and this will not go to trial until December, 2012? Seems there is something seriously wrong with our justice system, and if he breaches his bail, he “might” be brought back to court and it “could” result in his remand. What happened to he “will” be brought back to court and it “will” result in his remand. This is where the courts and the justice system are failing the victims.
Its called presumed innocence until proven guilty in a court of law. If he were falsely accused, he still deserves his day in court. The scales of the justice system must weigh equal balance to the parties until the process has been completed. However i do agree with you, one year is FAR too long.
It is possible that although the incidents allegedly took place in 2011 they were not reported until recently and/or formal charges were not pursued. If he is being charged today and court date has been set for 5 months from now, that is actually not a bad turnaround time as far as the justice system goes.
I agree why wait so long to bring a case like this to the table… this ia a VERY serious matter.
ok so i’m thinking the same thing (somebodies momma), so he cant come into contact with these two girls so whos to say that this damm pervert is not going to try some $hit with another little girl, while out on bail, this is the problem with our justice system, it protects the criminal more then it does the victim.
