Re: Ministerial Direction to the Regulatory Authority on the National Electricity Sector Policy 2026 and Integrated Resource Planning

Following consultation with the Regulatory Authority ["the Authority"], the Ministry of Home Affairs issues this Direction to establish the policy foundation on which integrated resource planning in the electricity sector is to proceed.
The Regulatory Authority was established under The Regulatory Authority Act 2011 to protect the interests of consumers with respect to prices, affordability, and service quality; to promote economic efficiency, investment, innovation, and sustainable competition; and to support the strategic and social interests of Bermuda by ensuring access to reliable and affordable services. This Direction is issued to align the planning of Bermuda’s electricity future with the policy of the elected Government, while respecting the operational independence of the Authority as established by law.
On 27 May 2025 the Ministry issued a Ministerial Direction to the Authority addressing governance and transparency, capacity building, electricity sector regulation, and consumer protection and education. In July 2026 the Government published the National Electricity Sector Policy2026 ["NESP 2026"], which replaces the National Electricity Sector Policy 2015 and sets the Government’s direction for the electricity sector through to 2045.
In exercise of the powers under Section7[1] of the Regulatory Authority Act 2011 ["RAA 2011"] and Section 8[1], [2] and [3] of the Electricity Act 2016 ["EA 2016"]; and consistent with the purposes set out in Section 6[a], [e] and [f] of the EA 2016, the Ministry hereby directs the Regulatory Authority ["RA"] as follows:
In exercise of the powers of the Minister responsible for Home Affairs under Section 4 of the RAA 2011:
Adoption of the National Electricity Sector Policy 2026

The RA, consistent with its functions under Sections 14 and 15 of the EA 2016 and otherwise under the EA 2016, and its functions under Sections 12[b] and [e] of the RAA 2011 and otherwise under the RAA 2011, shall:
Treat NESP 2026 as the statement of Government policy for the electricity sector for the purposes of its regulatory, planning, and licensing functions.
Have regard to NESP 2026 in the exercise of those functions.
Continuity with the Ministerial Direction of 27 May 2025
The Ministerial Direction issued on 27 May 2025 remains in effect, and its components apply in the context of NESP 2026. The RA shall read the two Directions together, and shall treat the requirements of the 27 May 2025 Direction, including the incorporation of findings arising under that Direction into any future request for an Integrated Resource Plan under Section 40 of the EA 2016, as continuing obligations to be discharged consistently with NESP 2026.
Reporting
The RA is invited to submit a report on its approach to giving effect to NESP 2026 in the exercise of its planning and regulatory functions, with an indicative timetable, for the awareness of the Ministry of Home Affairs, within 90 days of the issuance of this Direction.
Informing Future Actions
The RA should incorporate NESP 2026 into its future electricity planning and policy-making processes, including any future tariff methodology under Section 35 of the EA 2016, any future General Determination on consumer protection under Section 38 of the EA 2016, and any future request for or review of an Integrated Resource Plan [IRP] under Section40 of the EA 2016.
