Guilty Plea: Defrauding Guesthouses

In Magistrates Court this morning [Nov.14], 53-year-old Dana Martin pleaded guilty to two charges of defrauding two Bermuda guesthouses over $9,000.

The charges stemmed from Mr Martin’s use of guest accommodation at Blue Horizons Guesthouse; running up a bill of $2,875 and then not paying that bill. Martin’s use of that accommodation was between 15th October 2011 and 8th November 2011

The second charge related to Mr Martin’s use of accommodation at Little Pomander Guesthouse between 14th August 2011 and 7th October 2011. In this incident he was charged with running up a bill of $6,300.

According to DPP Prosecutor Carrington Mahoney, in both cases Mr Martin had put off the Guesthouse owners by claiming variously that he was having trouble with his bank, was a business owner planning to bring in foreign workers, would be seeking additional accommodation for these workers, or was having short-term legal and business problems.

On several occasions, and with the Guesthouse owner present and overhearing one side of the telephone conversation, Mr Martin was said to have made telephone calls to his bank in an effort to sort out what he said were his banking problems.

Unrepresented, except by Duty Counsel lawyer Leopold Mills, Mr Martin told the Senior Magistrate that he was due to start work on Monday 21st November and promised to repay the funds.

Senior Magistrate Archie Warner ruminated that a custodial sentence was in order but that jailing Mr Martin would cost the taxpayer $80,000 for one year and the owners would still be out-of-pocket.

The Magistrate then ordered an adjournment until 10:00am tomorrow morning when Mr Martin will re-appear and should bring his prospective employer.

    This guy has been at this game for years now. He stole from his poor mom god bless her soul then he stole hundreds of thousands from people pretending to be an investment broker. then he goes on to work at south princess on the 6th floor where he met and conned a guest. it always so amazing how this guy gets slapped on the wrist. I feel sorry for his kids must be a real embarrasment to them. i say lock his a$$ up like everyone else.

        He’s a B … S… artist & always has been since school . . . Martin will never never change! He should be once locked up & pay off his debts too. I feel for his young adult children as this is not the first time that he is an embarrassment beyond words to them.

      The Magistrate is concerned about the cost to the taxpayer should this fraudster be incarcerated. Where is the same concern for the majority blacks who are currently serving time in Bermuda’s prisons?

    $3000.00 & $6000.00… How does this make news??? People are in court every week for rental arrears worth thousands more. The landlord is lucky if a few hundred a month is awarded then the tennant sandbags paying even that little until it is taken straight from their wages.

    Now how fair is that?

    This guy is INCREDIBLE – he could be a politician the way he gets people to believe his stories. For at least 10 years, I have read about his con activities. Has he EVER served any time? I used to work at South P and knew him, I could never figure out how he did it to people because I wouldn’t lend him a nickel, he just seemed so untrustworthy. Must have a gift for sussing out the victims who don’t have a con radar. And he keeps finding people to employ him too. Don’t they do background checks? i know so many honest people who can’t find work and this guy can….SMH
