Three Drunk Drivers Appear In Magistrates Court

This morning’s [Aug 21] Plea Court led off with three consecutive cases involving Driving Whilst Impaired [DWI] with all three persons pleading guilty and admitting having over 80mg of alcohol in 100ml of blood.

Two of the cases arose from police stops after police had observed erratic driving. One was after an accident had occurred. All three took the police administered alco-analyzer test at Hamilton Police Station.

First up was James Cooney, 19. He pleaded guilty to DWI on 18th August. Police stopped him on Front Street at 2:35am. He had 138mg of alcohol in 100ml of blood. At the time, he was driving a car with two passengers in it.

Second person up was Michael Skinner, 36. He had been involved in a two vehicle collision on 18th June. He was riding a bike and carrying his daughter as pillion passenger. He had 208mg in 100ml.

Third person was Troy Lewis, 43. He was stopped at 2:45am on 20th August on South Shore Road in Warwick. He had 127mg in 100ml. He was alone in his car.

Senior Magistrate Archie Warner awarded each person an $800 fine and disqualified each person from driving all vehicles for twelve months.

    Interestingly, the standard DUI fine has gone down recently from $1,000 to $800.

    And, sure enough, in July there were 177 road accidents including 3 deaths. Last week the police issued a warning about the proliferation of DUI incidents.

    Why would the courts start getting more lenient, just as DUI’s are getting worse? What is going through the magistrate’s minds?

        @Observer-are you kidding? Because there’s a recession, the courts should get more lenient with people who break the law so they can afford the fines? The fines should stay as they are-or get stiffer-as a deterrent to these idiots. If they can’t pay, they go straight to prison. We can’t say that ‘people may go and rob.’ They could go and rob for a fine no matter how small…that’s a chance that we take-we can’t use that as an excuse to go soft on people.

        The guy riding with his daughter should have got the book thrown at him-he could have gotten her killed.

        Observer, yet another silly comment from you. What a ridiculous thing to say, let alone actually type out and post. Drunk driving is a serious offence, they need to be stripped of their license and heavily fined.

        Really a recession hello they were drunk what do you think they were drunk from the sun! Liquor costs money not a necessity to live. DUI how many deaths have been caused by DUI if he locked them up maybe they would learn their lesson instead he locks you up for driving while disqualified not being caught behind the wheel nor having keys nor being anywhere near the car. Really.

      You’re totally right. Ok here’s the deal. You seem to be really concerned so lets say one friday/saturday a month you put some cones on east broadway and stop traffic. If you suspect someone is under the influence you either attempt a citizens arrest or you quickly take note of their license plate, a description of the vehicle and the driver and call the Hamilton police station. The dispatcher will then proceed to inform the nearest officer.

      An even awesomer idea would be to try to solicit a bribe from the suspect. Then you’d be making loot! Then you could go get hot and still afford a taxi home. WIN WIN!

      I’m pretty sure theyre referring to the accident he had on June 18th where his daughter was a passenger.

    This guy had his daughter on the bike and was 2.5 times over the limit!? Candidate for Father of the Year right there… SMDH.

    The guy Michael Skinner riding a bike and carrying his daughter as pillion passenger – is a complete idiot!!! He should have to pay a “double fine” for endangering her life!!

    He was way over the limit (208mg in 100ml) – but these idiots NEVER seem to learn!! Take their licenses for 3 years in future – as they are endangering every body else on the road!!!
