33 Year Old Disqualified From Driving Until 2019

Appearing in Magistrates Court this morning [Nov 28], 33-year-old Kevin Mendonca was fined $2,500 and disqualified from driving until 2019,.

Initially Mr Mendonca, a resident of Warwick, plead guilty to the first charge of driving whilst impaired on 14 November 2014.

The Magistrate advised him that perhaps he should listen to the second charge, as the second and alternate charge of refusing to take the breathalyzer test attracted a lower penalty.

The Magistrate put the second charge and Mr Mendonca plead guilty to that as well. The Magistrate asked the Prosecutor what she intended to do as only one charge could go ahead. The Prosecutor said that the Crown would offer no evidence on the first charge of driving whilst impaired.

Magistrate Khamisi Tokunbo then convicted Mr Mendonca and fined him with a three year disqualification, however court records showed that he had been disqualified just over a month before, in October 2014.

The Magistrate’s final ruling was that the three year disqualification was to run consecutive to the previous two year disqualification, meaning that Mr Mendonca was effectively disqualified to October 2019.

      I agree SNS. All the time we read about sentences running concurrently for murderers, burglars, violent offenders and the whole shebang of nasty crimes. Yet this man gets consecutive sentencing for DWI? I don’t condone his actions and agree with the sentence he received but surely this should be done with the aforementioned crimes as well. Our justice system makes no sense to me at all. It seems the worse the crime is, the less punishment one receives and the more rights those offenders have. The victims have none. If you’ve noticed, it is the victims, police and professionals who get grilled on the stands by lawyers during any trial while the offenders have the right to just sit there and smirk.

      How about sending a message to the High speeders out there, I was passed on N shore rd by more than 10 speeders yesterday. They need the same fines and disqualifications as the DUI’rs get.

    You have to wonder what effect this is going to have on his behaviour. After all, if he was already disqualified before he was stopped this time what makes anyone think that he’s going to obey the suspension this time around.
