“Don’t Steal in Loyal Hill”

This evening [Nov 4] a sheet flys on North Shore at the entrance to Loyal Hill saying “Don’t Steal in Loyal Hill,” an obvious reference to the incident earlier that saw an alleged burglar beaten by members of the public and carted away by ambulance.

The Police say that “it is alleged that the victim, a 43 year old Sandys parish man, was discovered attempting to burglarize an area home. The Sandys parish man was apparently injured by members of the public as he tried to flee the scene on foot and has been taken to King Edward VII Memorial Hospital via ambulance for treatment.”

    Morally, it’s a no brainer but once off your property and no longer a threat, being knocked unconscious is an assault. Difficult one for the police; damned if you do, damned if you don’t.

        Opnions don’t change the law. Beaten up IN the house, on the lawn, I’d say the law could accept some force being used to prevent escape or to defend oneself or property….several people with weapons chasing and beating a person running away, I’m sorry, but it’s an assault.
        I’m not saying I wouldn’t do it, I’m just saying it’s an assault.
        For it not to be, the level of force would have to have been proportionate, legal and necessary and this (I am arguing) is none of the above.
        I’d ask you to remember, I’m not commenting on what they did or why or who deserved what, what I’m telling you is my intepretation of the law.

          The law doesn’t really matter as most people that go to court for assault in Bermuda get off very quickly.

    Terry and Mark, from the people of Bermuda go f@%& yourselves!!!! You obviously never grew up in Bermuda where most people didn’t have a key to any locks in their houses for many many many years! just of late have we had to lock up our doors and spend $$$$$$$$ on security because these addicts cant balance their highs with reality! drugs have been around and they where here back in the 70’s when Bermudians had no keys for their doors but we didnt have this crime!!!! Its just this day in age everyone wants to make an excuse for their down fall instead of manning up and providing for themselves on all fronts!!! At some point the majority of this island has suffered financial downfalls or some sort of hardship but that doesn’t mean we have to steal from each other or live life in a criminal way! Ive had my house robbed twice and both times the culprits have taken @ss whoooooooooooooopens!!!! I lived in two different locations and they are two separate matters. But check this we all know who the culprits are and they will reveal themselves eventually! both culprits have seen me face to face and when i pass them this day in age they are scared of me! I bet that guy will have the same fear when he passes that person who DEFENDED their-self. All you read in the paper these days are burglaries weather it be in a home, these cheap guest houses, old folks at the beach, etc. My grand mother always told me “leave well enough alone!!!” and today this guy decided to bother “well enough” and it back fired! I don’t need any comments back because i will not reply but to Bermuda take this as a stepping stone and lets get like the Argentina’s and the Jamaica’s and the Columbia’s and get off our @sses and force our police and our governments to do the RIGHT job!!!!long have we sat back with all the right ideas and voices and let the leaders of us benefit themselves while leaving us in a bigger wake than when they began their duties and responsibilities!!!! TIME TO TAKE OUR OWN STAND!!!!! this guy today was the beginning!!!!!

      Very well put! It seems that today the law seems more interested in making sure that the CROOK’S legal and civil rights are protected while the victims that are left behind are the ones left with paying the insurance, the medical bills, the deductible expenses and the FEAR of it happening again. Meanwhile the perp gets the slap on his wrist.
      It is time to put Bermuda first and get her back to the days when you left the house to go to the beach or fishing or go to church without having to lock anything.
      I am just saying.

        Me too! Street Justice seems to be more effecient these days. One lady told me about her house being broken into and she knew who did it but the Bermuda cops did nothing about like they were protecting the criminal. They must have known him or were related to him. I say beat their @sses but just don’t gravely injure them. Break em off something proper! unless this guy is retarded he won’t be targeting the Loyal Hill area again.

It’s about time that these crackheads that break into people’s houses while hard working Bermudians like myself are at work get a lesson that the police cannot give to them!!!!I hope this incident puts all would be criminals on notice…enough is enough and you better think twice before you even think about stealing or breaking and entering into someone elses residence. Bermudians should stand strong against this foolishness like what happened yesterday.     I know what the law is especially if there is no proof of intent (so they say), but trust and believe you break into my home that’s all the “proof of intent” I need. How am I suppose to know if your not carrying a weapon or your “intentions” are only to steal and even if you are there to steal my belongings you are getting a beat down no doubt (by any means necessary). I work too damn hard for what I have in my home and if the law is actually going to protect these fools who are breaking into our homes that is just outlandish! The whole system needs to be changed and I am hoping something is done about it soon. He got what he deserved and I am sure he’ll think twice before breaking in someone’s home again.

    He was always a good boy, never in trouble, he was just turning his life around, it was his first time, he’s since found the Lord, he’d never hurt nobody, he just needs a break, it was his first time, he only stole cos he was desperate, he can’t make it in todays racist society, he’s been clean for months, this is his first bit of trouble since he got out, please don;t send him back to jail for a tenth time, he just needs one more chance your honour…………

    Are you both douches or what what makes you think it’s only non-Bermudians or people that didn’t grow up here who are saying what happened yesterday went over and beyond neccessary force and you don’t speak for all Bermudians. Yes if someone broke into my house I would defend my home with all I had but once the thief is out of your house and off your porperty it’s a whole new kettle of fish. The law even though some things in it we don’t like is still the law. You go an beat a thief 20 yards down the rode then you end up in trouble as well and if you beat a thief because he robbed your neighbour don’t be suprised if you end up in cuffs. So all you ignnorant asses that keep bashing anyone that tells you the facts need to go educate yourselves. They aren’t saying don’t defend your property they are saying excessive force can also land you in the courts as well. Yes we’d all like to take the criminals and string them up and beat the crap put of them but we can’t according to the law, and if you say well forget the law lets all band together then don’t bitch and complain when other crimes happen because what’s good for the goose is good for the gander.

      My statement below goes for you too, because someone disagrees with you it makes them ignorant. Although I agree that you are coming from a diferent angle, instead of calling people ignorant, then maybe you should try listing points and teaching them. Not everyone is well versed in the law. However everyone is well versed in opinions. Like the saying goes…..”opinions as like a$$h0les, everyone has one”.

      If you want people to see or understand your point of view then maybe you should give then points or teach them about it to help them understand.

      And I tell you what. if you got broken into and in the heat of the moment and being afraid, you may just find that you have chased them out of you house and done the street……So although i disgree with accessive force, you better damn well believe that I will go after you and I will hit you with all my might!!

      Curious, in Bermuda people rarely get in trouble for assault unless it is with a deadly weapon. I know many people who have gotten their a… kicked and nothing ever happened to the person that did it. These cases usually get thrown out. If you can harbor a fugitive and not get into trouble, do you really think someone is going to get in trouble for beating up a thief regardless of where it occurs. Start reading the paper and you will see how many cases get thrown out of court, it is quite amazing.

    In present day; I know ENOUGH ppl that sleep with weapons beside the bed for this EXACT reason. You break into a home, you get what you deserve. Had you not been there in the first place, you’d be ‘conscious’ in your own space and not sprawled out. No difference if it was one person or the entire neighborhood… on the lawn or the middle of the streets you got what YOU asked for.

    Tell you what… I bet it’s a lesson learned on his part! For the ppl that don’t feel the same, I wanna hear your view after your home is broken into… your sense of safety has been stolen along with your property… and God forbid if the burglar harms YOU!

    More ppl need to come together! Not just for this… just crime PERIOD!

    Curious has a right to speak as we all do, We can all disagree, but the one thing i do not like is to assume that he’s “Posh” because of what he says. I don’t know about you but the only thing i can see about them is his or her pen name. If you all read my other post then you will see that I am in agreement of the criminal getting a good beating…. but that being said, Why would you assume that those for or against are posh or live in well to do neighbours or in the ghetto. I think you loosing view of the big picture. Bermuda is about and INCH (u get my point) big. Unless you live in tuckers town and have a guarded entry to your area then this affects all of us. I live neither in a posh area or a ghetto. I live in a normal area and to me Loyal hill is also a normal area. So is MOST of the island. All of this affects Bermuda as a whole and I have been broken into and chased the person with a bat. Wake up Bermuda!!! This is part of the problem. THERE IS NO YOU OR ME, THERE IS NO BLACK OR WHITE, THERE IS NO FAIRYLANDS OR COURTSTREET. THIS IS HAPPENING EVERY WHERE AND THIS WILL NOT STOP UNTIL WE STOP DOING THIS!! STOP THESE ASSUMPTIONS AND DIVISIONS. Or else all this will ever be is people kicking up a stink on an internet forum!! and before you judge me YES I”M BERMUDIAN YES I HAVE BEEN ROBBED AND ATTACKED MYSELF!!! AND i’M A WOMAN! this division has to stop as this is part of the problem a huge problem and Bermuda will never be fixed if this continues.       Perhaps in the future you may choose to resort to multiple paragraphs instead one jumbled paragraph with run on sentences and an intermittent use of upper case.

    Just like you pointing out the law doesn’t make you a defender of it, them condoning this beating doesn’t make them criminals. They are frustrated at the move in many ‘developed’ nations towards lawyers making a fortune protecting the rights of those who strike fear and uncertainty into the hearts and minds of many.

    More often than not the victim and certainly future victims of proven recidivists are forgotten and not protected. The system is too busy making sure the police didn’t swear at him/her or ask too many questions quickly without a bathroom break, or raise their voices, or the forensic team didn’t have one sample within 4 miles of another one, or whatever!! Trials are very rarely about “Did he/she do it”, they are more about “Did the authorities investigate it properly”.

    I do appraciate the need for a thorough defence, a principle upon which justice is formed in civilized societies but like the UK and the US, Bermuda has just gone way too far the other way in my humble opinion.

    That said, these folks that chased and beat the guy with helmets and bats or whatever it was, committed an assault, that’s not even in question, that’s absolute. Whether it’s in the public interest to prosecute is quite another.

    If this guy is sitting at Hamilton station making a complaint of assault, police are duty bound to investigate, end of. If they don’t or the DPP decides not to proceed, that could set a dangerous precedent going forward and that for the powers that be to weigh up. If they do proceed, I’d envisage a public outcry and jury pool s tainted as to make a trial a farce and a foregone conclusion (another MASSIVE problem here in terms of blind justice).

    As law evolves it draws lines in the sand as to what is and what is not acceptable, I await with interest to see what happens here.
